s 64 Forfeiture of goods, etc., seized

(1) Any book, record, apparatus, equipment, instrument, material, article, sample, blood, blood product, human tissue or fluid or any product of the human body, dialysate, chemical, pharmaceutical, substance or any other thing seized in exercise of any power conferred under this Act shall be liable to forfeiture. (2) An order for the forfeiture or for the release of all the things seized and liable to forfeiture under this Act shall be made by the court before which the prosecution with regard thereto has been held and an order for the forfeiture of the things seized shall be made if it is proved to the satisfaction of the court that an offence under this Act has been committed and that the things seized were the subject matter of or were used in the commission of the offence, notwithstanding that no person have been convicted of such offence. (3) Where there is no prosecution with regard to anything seized, such thing shall be taken and deemed to be forfeited at the expiration of one calendar month from the date of service of a notice to the last known address of the person from whom the thing was seized indicating that there is no prosecution in respect of such thing, unless before that date a claim thereto is made in the manner as set out in subsections (4), (5) and (6). (4) Any person asserting that he is the owner of the thing seized under subsection (3) and that it is not liable to forfeiture may personally or by his agent authorized in writing give written notice to the authorized officer in whose custody such thing is held that he claims the thing. (5) On receipt of the notice referred to in subsection (4), the authorized officer shall refer the matter to a Judge of a Sessions Court for a decision. (6) The Judge to whom a matter is referred under subsection (5) shall issue a summons requiring the person asserting that he is the owner of the thing seized and the person from whom it was seized, to appear before the Judge, and on his appearance or default to appear, due service of the summons having been proved, the Judge shall proceed to the examination of the matter and on proof that an offence under this Act has been committed and that the thing seized was the subject matter of or was used in the commission of such offence, shall order the thing to be forfeited and shall, in the absence of such proof, order its release. (7) Subject to subsection (2), any things forfeited or deemed to be forfeited shall be delivered to the authorized officer and shall be disposed of in a manner to be determined by the Director General. (8) If the authorized officer is satisfied that any blood, blood product, human tissue or fluid or any product of the human body, dialysate, chemical, pharmaceutical, substance or any other thing, contains a hazardous contaminant, the authorized officer shall cause the blood, blood product, human tissue or fluid or any product of the human body, dialysate, chemical, pharmaceutical, substance or any other thing, to be destroyed in a manner to be determined by the Director General.

Pelucuthakan barang, dsb., yang disita

(1) Apa-apa buku, rekod, perkakas, kelengkapan, alat, material, barang, sampel, darah, hasil darah, tisu atau bendalir manusia atau apa-apa hasil badan manusia, dialisat, bahan kimia, bahan farmaseutikal, bahan atau apa-apa benda lain yang disita dalam penjalanan apa-apa kuasa yang diberikan di bawah Akta ini boleh dilucuthakkan. (2) Suatu perintah bagi pelucuthakan atau bagi pelepasan semua benda yang disita dan boleh dilucuthakkan di bawah Akta ini hendaklah dibuat oleh mahkamah yang di hadapannya pendakwaan berkenaan dengannya telah diadakan dan suatu perintah bagi pelucuthakan benda yang disita hendaklah dibuat jika dibuktikan sehingga mahkamah berpuas hati bahawa suatu kesalahan telah dilakukan di bawah Akta ini dan benda yang disita itu ialah hal perkara atau telah digunakan dalam pelakuan kesalahan itu, walau apa pun bahawa tiada orang telah disabitkan atas kesalahan itu. (3) Jika tiada pendakwaan berkenaan dengan apa-apa benda yang disita, benda itu hendaklah diambil dan disifatkan terlucut hak apabila tamat tempoh satu bulan kalendar dari tarikh penyampaian notis ke alamat terakhir yang diketahui bagi orang yang daripadanya barang itu telah disita yang menunjukkan bahawa tiada pendakwaan berkenaan dengan benda itu, melainkan jika sebelum tarikh itu suatu tuntutan telah dibuat mengikut cara yang ditetapkan dalam subseksyen (4), (5) dan (6). (4) Mana-mana orang yang menegaskan bahawa dia ialah tuan punya benda yang disita di bawah subseksyen (3) dan bahawa benda itu tidak boleh dilucuthakkan boleh dengan sendirinya atau melalui ejennya yang diberi kuasa secara bertulis memberikan notis bertulis kepada pegawai yang diberi kuasa yang dalam jagaannya benda itu dipegang bahawa dia menuntut benda itu. (5) Apabila menerima notis yang disebut dalam subseksyen (4), pegawai yang diberi kuasa hendaklah merujuk perkara itu kepada Hakim Mahkamah Sesyen bagi suatu keputusan. (6) Hakim yang kepadanya perkara itu dirujukkan di bawah subseksyen (5) hendaklah mengeluarkan suatu saman yang menghendaki orang yang menegaskan bahawa dia ialah tuan punya benda yang disita itu dan orang yang daripadanya benda itu disita, untuk hadir di hadapan Hakim, dan apabila dia hadir atau ingkar untuk hadir, setelah dibuktikan bahawa saman itu telah disampaikan dengan sewajarnya, Hakim itu hendaklah meneruskan pemeriksaan tentang perkara itu dan apabila dibuktikan bahawa suatu kesalahan telah dilakukan di bawah Akta ini dan bahawa benda yang disita itu ialah hal perkara bagi atau telah digunakan dalam pelakuan kesalahan itu, hendaklah memerintahkan benda itu dilucuthakkan dan hendaklah, jika tiada bukti sedemikian, memerintahkan pelepasan benda itu. (7) Tertakluk kepada subseksyen (2), apa-apa benda yang dilucuthakkan atau disifatkan telah dilucuthakkan hendaklah diserahkan kepada pegawai yang diberi kuasa dan hendaklah dilupuskan mengikut cara yang ditentukan oleh Ketua Pengarah. (8) Jika pegawai yang diberi kuasa berpuas hati bahawa apaapa darah, hasil darah, tisu atau bendalir manusia atau apa-apa hasil badan manusia, dialisat, bahan kimia, bahan farmaseutikal, bahan atau apa-apa benda lain, mengandungi pencemar merbahaya, pegawai yang diberi kuasa itu hendaklah menyebabkan darah, hasil darah, tisu atau bendalir manusia atau apa-apa hasil badan manusia, dialisat, bahan kimia, bahan farmaseutikal, bahan atau apa-apa benda lain, dimusnahkan mengikut cara yang ditetapkan oleh Ketua Pengarah.
