s 87 Transitional

(1) Any person who is operating or providing a pathology laboratory before the commencement of this Act and intends to continue to operate or provide the pathology laboratory on or after such commencement shall, not later than six months from the date of commencement of this Act, apply to the Director General for a licence under this Act. (2) Pending the decision by the Director General on the application for a licence made under subsection (1), the applicant shall be deemed to be licensed under this Act and no action shall be taken against the applicant for operating or providing a pathology laboratory without a licence. (3) Where a licence is granted by the Director General under paragraph 16(a) pursuant to an application made under subsection (1), the applicant shall within six months from the date the licence is granted, take the necessary action to comply with the terms and conditions imposed in the licence, if any. (4) Where a licence is not granted by the Director General under paragraph 16(b), the applicant referred to in subsection (2) shall cease to be deemed to be licensed under that subsection from the date the applicant is notified of the decision of the Director General or, if there is an appeal under section 72, the date of the decision of the Minister on that appeal. Peralihan

(1) Mana-mana orang yang mengendalikan atau menyediakan makmal patologi sebelum permulaan kuat kuasa Akta ini dan berniat untuk terus mengendalikan atau menyediakan makmal patologi pada atau selepas permulaan kuat kuasa itu hendaklah, tidak lewat daripada enam bulan dari tarikh kuat kuasa Akta ini, memohon kepada Ketua Pengarah bagi suatu lesen di bawah Akta ini. (2) Sementara menunggu keputusan oleh Ketua Pengarah mengenai permohonan bagi lesen yang dibuat di bawah subseksyen (1), pemohon hendaklah disifatkan sebagai dilesenkan di bawah Akta ini dan tiada tindakan boleh diambil terhadap pemohon itu bagi pengendalian atau penyediaan makmal patologi tanpa lesen. (3) Jika suatu lesen diberikan oleh Ketua Pengarah di bawah perenggan 16(a) menurut permohonan yang dibuat di bawah subseksyen (1), pemohon hendaklah dalam tempoh enam bulan dari tarikh lesen itu diberikan, mengambil tindakan yang perlu untuk mematuhi terma dan syarat yang dikenakan dalam lesen itu, jika ada. (4) Jika suatu lesen tidak diberikan oleh Ketua Pengarah di bawah perenggan 16(b), pemohon yang disebut dalam subseksyen (2) hendaklah terhenti untuk disifatkan sebagai dilesenkan di bawah subseksyen itu dari tarikh pemohon itu diberitahu tentang keputusan Ketua Pengarah itu atau, jika terdapat rayuan di bawah seksyen 72, tarikh keputusan Menteri mengenai rayuan itu.
