s 104 Offences by body corporate, etc.
Where an offence under this Act or any regulations made under this Act has been committed by a body corporate, partnership or society—
(a) in the case of a body corporate, any person who was a director, manager, secretary or other similar officer of the body corporate at the time of the commission of the offence;
(b) in the case of a partnership, every partner in the partnership at the time of the commission of the offence; or
(c) in the case of a society, every office bearer of the society at the time of the commission of the offence,
may be charged severally or jointly in the same proceedings with the body corporate, partnership or society and shall be deemed to be guilty of that offence unless he proves that the offence was committed without his knowledge or connivance or that he took all reasonable precautions and had exercised due diligence to prevent the commission of the offence.

Kesalahan oleh pertubuhan perbadanan, dsb.
Jika sesuatu kesalahan di bawah Akta ini atau mana-mana peraturan-peraturan yang dibuat di bawah Akta ini telah dilakukan oleh sesuatu pertubuhan perbadanan, perkongsian atau persatuan—
(a) dalam hal suatu pertubuhan perbadanan, mana-mana orang yang merupakan pengarah, pengurus, setiausaha atau pegawai lain yang seumpamanya dalam pertubuhan perbadanan itu pada masa pelakuan kesalahan itu;
(b) dalam hal suatu perkongsian, tiap-tiap pekongsi dalam perkongsian itu pada masa pelakuan kesalahan itu; atau
(c) dalam hal suatu persatuan, tiap-tiap pemegang jawatan persatuan itu pada masa pelakuan kesalahan itu,
boleh didakwa secara berasingan atau bersesama dalam prosiding yang sama bersekali dengan pertubuhan perbadanan, perkongsian atau persatuan itu dan hendaklah disifatkan telah melakukan kesalahan itu melainkan jika dia membuktikan bahawa kesalahan itu telah dilakukan tanpa pengetahuannya atau pembiarannya atau bahawa dia telah mengambil segala langkah yang munasabah dan telah menjalankan segala usaha yang wajar untuk mencegah pelakuan kesalahan itu.
