s 60 Revocation of accreditation

(1) Subject to the provisions of this section, the Agency may, at any time, revoke the certificate of accreditation granted to a higher education provider under paragraph 57(1)(a) if the higher education provider breaches any condition attached to the certificate. (2) A written notice of the intention to revoke the certificate of accreditation shall be served on the higher education provider and the notice shall specify the grounds for such revocation. (3) The higher education provider shall be given an opportunity to make written representations within thirty days from the date of the notice in subsection (2). (4) After the expiry of the period of thirty days stated in subsection (3) and after considering any representation made under that subsection, the Agency shall— (a) issue a warning and give directions for the higher education provider to rectify the situation to the satisfaction of the Agency within a specified period; or (b) proceed with the proposed action to revoke the certificate of accreditation. (5) If the higher education provider fails to rectify the situation as required under paragraph (4)(a), the Agency may proceed to revoke the certificate of accreditation. (6) Where the certificate of accreditation has been revoked, the Agency shall enter the date of revocation into the Register and shall give notice of the revocation to the relevant authority.

Pembatalan akreditasi

(1) Tertakluk kepada peruntukan seksyen ini, Agensi boleh, pada bila-bila masa, membatalkan perakuan akreditasi yang diberikan kepada sesuatu pemberi pendidikan tinggi di bawah perenggan 57(1)(a) jika pemberi pendidikan tinggi itu melanggar mana-mana syarat yang dilampirkan pada perakuan itu. (2) Suatu notis bertulis mengenai niat untuk membatalkan perakuan akreditasi hendaklah disampaikan kepada pemberi pendidikan tinggi dan notis itu hendaklah menyatakan alasan bagi pembatalan itu. (3) Pemberi pendidikan tinggi itu hendaklah diberi peluang untuk membuat representasi bertulis dalam masa tiga puluh hari dari tarikh notis dalam subseksyen (2). (4) Selepas tamat tempoh tiga puluh hari yang dinyatakan dalam subseksyen (3) dan selepas menimbangkan apa-apa representasi yang dibuat di bawah subseksyen itu, Agensi hendaklah— (a) mengeluarkan amaran dan memberikan arahan supaya pemberi pendidikan tinggi itu membetulkan keadaan sehingga Agensi berpuas hati dalam masa yang ditentukan; atau (b) meneruskan dengan cadangan tindakan untuk membatalkan perakuan akreditasi itu. (5) Jika pemberi pendidikan tinggi gagal untuk membetulkan keadaan sebagaimana yang dikehendaki di bawah perenggan (4)(a), Agensi boleh meneruskan untuk membatalkan perakuan akreditasi itu. (6) Jika perakuan akreditasi telah dibatalkan, Agensi hendaklah memasukkan tarikh pembatalan itu ke dalam Daftar dan hendaklah memberikan notis pembatalan kepada pihak berkuasa yang berkenaan.
