s 44 Surrender of travel documents

(1) Notwithstanding any written law to the contrary, the Public Prosecutor or an officer of the Commission of the rank of Commissioner or above as authorized by the Public Prosecutor may, where he has grounds to believe that any person who is the subject of an investigation in respect of an offence under this Act suspected to have been committed by him is likely to leave Malaysia, by written notice require such person to surrender his certificate of identity, passport or exit permit, or any other travel document in his possession. (2) A notice under subsection (1) shall be served personally on the person to whom it is addressed. (3) A person on whom a notice under subsection (1) is served shall comply with such notice forthwith, failing which he may be arrested and taken before a Magistrate. (4) Where a person is taken before a Magistrate under subsection (3), the Magistrate shall, unless such person complies with the notice under subsection (1) or satisfies the Magistrate that he does not possess a travel document, by warrant commit him to prison— (a) until the expiry of the period of fourteen days from the date of his committal; or NOTE—This Act has replaced the Postal Services Act 1991 [Act 465]—see section 110 of Act 741. (b) until he complies with the notice under subsection (1), whichever occurs earlier. (5) For the purpose of subsection (4), a certificate signed by the Public Prosecutor or the officer of the Commission of the rank of Commissioner or above as authorized by the Public Prosecutor to the effect that the person has complied with the notice under subsection (1) shall be sufficient warrant for the Superintendent of Prison to discharge such person. (6) No legal proceedings shall be instituted or maintained against the Government, an officer of the Commission, a public officer or any other person, in respect of anything lawfully done under this section.

Penyerahan dokumen perjalanan

(1) Walau apa pun mana-mana undang-undang bertulis yang berlawanan, Pendakwa Raya atau seorang pegawai Suruhanjaya yang berpangkat Pesuruhjaya atau yang lebih tinggi yang diberi kuasa oleh Pendakwa Raya boleh, jika dia ada sebab untuk mempercayai bahawa mana-mana orang yang menjadi subjek penyiasatan berkenaan dengan sesuatu kesalahan di bawah Akta ini yang disyaki telah dilakukan olehnya mungkin meninggalkan Malaysia, dengan notis bertulis menghendaki orang itu supaya menyerahkan perakuan pengenalan, pasport atau permit keluarnya, atau apa-apa dokumen perjalanan yang lain dalam milikannya. (2) Notis di bawah subseksyen (1) hendaklah disampaikan secara kendiri pada orang yang kepadanya ia dialamatkan. CATATAN—Akta ini telah menggantikan Akta Perkhidmatan Pos 1991 [Akta 465]—lihat seksyen 110 Akta 741. (3) Seseorang yang padanya suatu notis di bawah subseksyen (1) disampaikan hendaklah mematuhi notis itu dengan segera, dan jika tidak dia boleh ditangkap dan dibawa ke hadapan Majistret. (4) Jika seseorang dibawa ke hadapan seseorang Majistret di bawah subseksyen (3), Majistret itu hendaklah, melainkan jika orang itu mematuhi notis di bawah subseksyen (1) atau memuaskan hati Majistret itu bahawa dia tidak memiliki dokumen perjalanan, dengan waran mengkomitkannya ke penjara— (a) sehingga habis tempoh empat belas hari dari tarikh pengkomitannya; atau (b) sehingga dia mematuhi notis di bawah subseksyen (1), mengikut mana-mana yang berlaku dahulu. (5) Bagi maksud subseksyen (4), suatu perakuan yang ditandatangani oleh Pendakwa Raya atau pegawai Suruhanjaya yang berpangkat Pesuruhjaya atau yang lebih tinggi yang diberi kuasa oleh Pendakwa Raya yang bermaksud bahawa orang itu sudah mematuhi notis di bawah subseksyen (1) hendaklah menjadi waran yang mencukupi untuk Penguasa Penjara melepaskan orang itu. (6) Tiada prosiding undang-undang boleh dimulakan atau dikekalkan terhadap Kerajaan, seseorang pegawai Suruhanjaya, seseorang pegawai awam atau mana-mana orang lain berkenaan dengan apa-apa jua yang dilakukan dengan sah di bawah seksyen ini.
