s 86 Preservation of secrecy
(1) Without prejudice to section 88, and except for the purpose of the performance of his duties or the carrying out of his functions or when lawfully required to do so by any court or under any law, no person who is or has been director, officer, or employee of the Bank or member of the Shariah Advisory Council or any committee appointed under this Act shall disclose to any person any information relating to the business or affairs of the Bank or of a financial institution or of a customer of the Bank or of a financial institution which he has acquired in the performance of his duties or the carrying out of his functions.
(2) Any person who fails to comply with subsection (1) commits an offence and shall, on conviction, be liable to a fine not exceeding three million ringgit or to imprisonment for a term not exceeding three years or to both.

Pemeliharaan kerahsiaan
(1) Tanpa menjejaskan seksyen 88, dan kecuali bagi maksud melaksanakan kewajipannya atau menjalankan fungsinya atau apabila dikehendaki dengan sah untuk berbuat demikian oleh mana-mana mahkamah atau di bawah mana-mana undang-undang, tiada seorang pun yang menjadi atau pernah menjadi pengarah, pegawai atau pekerja Bank atau anggota Majlis Penasihat Shariah atau mana-mana jawatankuasa yang dilantik di bawah Akta ini boleh menzahirkan kepada mana-mana orang apa-apa maklumat yang berhubungan dengan urusan atau hal ehwal Bank atau sesuatu institusi kewangan atau seseorang pelanggan Bank atau sesuatu institusi kewangan yang diperolehnya dalam melaksanakan kewajipannya atau menjalankan fungsinya.
(2) Mana-mana orang yang tidak mematuhi subseksyen (1) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi tiga juta ringgit atau dipenjarakan selama tempoh tidak melebihi tiga tahun atau kedua-duanya.
