s 17 Suspension and revocation of permit

(1) The relevant Authority may, at any time, suspend or revoke a permit if— (a) the holder of the permit has failed to comply with any provisions of this Act; (b) the holder of the permit has failed to comply with any conditions attached to the permit; (c) the holder of the permit had improperly or illegally obtained the permit; or (d) it is necessary for national interest, national security or non-proliferation purposes, and shall notify the holder of the permit within thirty days by a notice in writing that the permit has been suspended or revoked. (2) A suspension or revocation under subsection (1) shall remain in force until the holder of the permit has taken measures to the satisfaction of the relevant Authority to remove the reasons for such suspension or revocation. (3) For the purpose of paragraph (1)(d), the determination of what amounts to national interest and national security shall be made by the Minister and such determination shall be final and binding upon all persons and shall not be challenged, appealed against, reviewed, quashed or questioned in any court.

Penggantungan dan pembatalan permit

(1) Pihak Berkuasa yang berkenaan boleh, pada bila-bila masa, menggantung atau membatalkan suatu permit jika— (a) pemegang permit tidak mematuhi mana-mana peruntukan Akta ini; (b) pemegang permit tidak mematuhi mana-mana syarat yang dikenakan atas permit; (c) pemegang permit telah mendapatkan permit itu secara salah atau secara haram; atau (d) adalah perlu bagi kepentingan negara, keselamatan negara atau maksud ketidakcambahan, dan hendaklah memberitahu pemegang permit itu dalam tempoh tiga puluh hari melalui notis bertulis bahawa permit itu telah digantung atau dibatalkan. (2) Suatu penggantungan atau pembatalan di bawah subseksyen (1) hendaklah terus berkuat kuasa sehingga pemegang permit itu mengambil langkah-langkah untuk menyingkirkan sebab-sebab bagi penggantungan atau pembatalan itu dengan memuaskan Pihak Berkuasa yang berkenaan. (3) Bagi maksud perenggan (1)(d), penentuan tentang maksud kepentingan negara dan keselamatan negara hendaklah dibuat oleh Menteri dan penentuan sedemikian hendaklah muktamad dan mengikat semua orang dan tidak boleh dicabar, dirayu, dikaji semula, dibatalkan atau dipersoalkan dalam mana-mana mahkamah.
