s 44 Cost of holding strategic items and unlisted items seized

Where any strategic items or unlisted items, or any container, package, conveyance or other article in which the strategic items or unlisted items are stored, kept or found, record, book, account, document or computerized data seized under this Act is held in the custody of the Government pending completion of any proceedings in respect of an offence under this Act, the cost of holding such strategic items, unlisted items, container, package, conveyance, article, record, book, account, document or computerized data in custody shall, in the event of any person being found guilty of an offence, be a debt due to the Government by such person and shall be recoverable accordingly.

Kos memegang barang strategik dan barang tidak tersenarai yang disita

Jika apa-apa barang strategik atau barang tidak tersenarai, atau apa-apa bekas, bungkusan, pengangkutan atau benda lain yang di dalamnya barang strategik atau barang tidak tersenarai itu distorkan, disimpan atau dijumpai, rekod, buku, akaun, dokumen atau data berkomputer yang disita di bawah Akta ini dipegang dalam jagaan Kerajaan sementara menunggu penyelesaian apa-apa prosiding berkenaan dengan sesuatu kesalahan di bawah Akta ini, kos untuk memegang barang strategik, barang tidak tersenarai, bekas, bungkusan, pengangkutan, benda, rekod, buku, akaun, dokumen atau data berkomputer itu dalam jagaan hendaklah, sekiranya mana-mana orang didapati bersalah atas suatu kesalahan, menjadi hutang yang kena dibayar kepada Kerajaan oleh orang itu dan boleh didapatkan semula dengan sewajarnya.
