s 22 Collection of credit information
(1) No credit reporting agency shall collect any credit information about a customer unless—
(a) the credit information is collected for a specific and lawful purpose directly related to an activity of the credit reporting agency and shall not be further processed in any manner incompatible with that purpose;
(b) the collection of the credit information is necessary for or directly related to that purpose; and
(c) the credit information is adequate but not excessive in relation to that purpose.
(2) A credit reporting agency which contravenes subsection (1) commits an offence and shall, upon conviction, be liable to a fine not exceeding five hundred thousand ringgit or to imprisonment for a term not exceeding two years or to both.
(3) The collection and use of credit information by a credit reporting agency under subsection (1) shall not require the consent of the customer concerned.

Pengumpulan maklumat kredit
(1) Tiada agensi pelaporan kredit boleh mengumpul apa-apa maklumat kredit mengenai seseorang pelanggan, melainkan jika—
(a) maklumat kredit itu dikumpul untuk suatu maksud khusus dan sah yang berhubungan secara langsung dengan suatu aktiviti agensi pelaporan kredit itu dan tidak boleh diproses selanjutnya mengikut apa-apa cara yang tidak selaras dengan maksud itu;
(b) pengumpulan maklumat kredit itu perlu bagi atau berhubungan secara langsung dengan maksud itu; dan
(c) maklumat kredit itu adalah mencukupi tetapi tidak berlebihan berhubung dengan maksud itu.
(2) Sesuatu agensi pelaporan kredit yang melanggar subseksyen (1) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi lima ratus ribu ringgit atau dipenjarakan selama tempoh tidak melebihi dua tahun atau kedua-duanya.
(3) Pengumpulan dan penggunaan maklumat kredit oleh suatu agensi pelaporan kredit di bawah subseksyen (1) tidak menghendaki persetujuan pelanggan yang berkenaan.
