s 23 Notice to customer on processing of credit information
(1) A credit reporting agency shall by written notice inform a customer—
(a) that credit information of the customer is being processed by or on behalf of the credit reporting agency, and shall provide a description of the credit information to that customer;
(b) the purposes for which the credit information is being or is to be processed;
(c) of any information available to the credit reporting agency as to the source of that credit information;
(d) of how to contact the credit reporting agency with any inquiries or complaints in respect of the credit information and of the customer’s right to request access to and to request correction of the credit information;
(e) of the subscribers or other persons to whom the credit reporting agency discloses or may disclose the credit information;
(f) of the choices and means the credit reporting agency offers the customer for limiting the processing of credit information, including credit information relating to other persons who can be identified from that credit information;
(g) whether it is obligatory or voluntary for the customer to supply the credit information;
(h) where it is obligatory for the customer to supply the credit information, the consequences for the customer if he fails to supply the credit information; and
(i) of a summary of the customer’s rights as contained in the Summary of Rights.
(2) The notice under subsection (1) shall be given as soon as practicable to the customer—
(a) when the credit reporting agency first collects the credit information of the customer; or
(b) when the customer is first asked to provide his credit information to the credit reporting agency,
and such notice shall be in the national and English languages.
(3) Where the credit reporting agency possesses a website, the credit reporting agency shall conspicuously display on its website a statement that sets out the purposes for which it collects credit information and the purposes for which the credit information will be further processed.
(4) A credit reporting agency which contravenes this section commits an offence and shall, upon conviction, be liable to a fine not exceeding five hundred thousand ringgit or to imprisonment for a term not exceeding two years or to both.

Notis kepada pelanggan mengenai pemprosesan maklumat kredit
(1) Suatu agensi pelaporan kredit hendaklah melalui notis bertulis memaklumkan seorang pelanggan—
(a) bahawa maklumat kredit mengenai pelanggan itu sedang diproses oleh atau bagi pihak agensi pelaporan kredit itu, dan hendaklah memberikan suatu perihalan mengenai maklumat kredit itu kepada pelanggan itu;
(b) mengenai maksud yang baginya maklumat kredit itu sedang atau akan diproses;
(c) mengenai apa-apa maklumat yang ada pada agensi pelaporan kredit tentang sumber maklumat kredit itu;
(d) mengenai cara bagaimana untuk menghubungi agensi pelaporan kredit mengenai apa-apa pertanyaan atau aduan berkenaan dengan maklumat kredit dan mengenai hak pelanggan untuk meminta akses kepada dan untuk meminta pembetulan terhadap maklumat kredit itu;
(e) mengenai orang yang melanggan atau orang lain yang kepadanya agensi pelaporan kredit itu menzahirkan atau boleh menzahirkan maklumat kredit itu;
(f) mengenai pilihan dan cara yang ditawarkan oleh agensi pelaporan kredit itu kepada pelanggan bagi mengehadkan pemprosesan maklumat kredit, termasuk maklumat kredit yang berhubungan dengan orang lain yang boleh dikenal pasti daripada maklumat kredit itu;
(g) sama ada wajib atau sukarela bagi pelanggan itu untuk memberikan maklumat kredit itu;
(h) jika wajib bagi pelanggan itu untuk memberikan maklumat kredit, akibat terhadap pelanggan itu jika dia tidak memberikan maklumat kredit itu; dan
(i) mengenai suatu ringkasan tentang hak pelanggan sebagaimana yang terkandung dalam Ringkasan Hak.
(2) Notis di bawah subseksyen (1) hendaklah diberikan kepada pelanggan secepat yang dapat dilaksanakan—
(a) apabila agensi pelaporan kredit itu mula-mula mengumpul maklumat kredit pelanggan itu; atau
(b) apabila pelanggan mula-mula diminta untuk memberikan maklumat kreditnya kepada agensi pelaporan kredit itu,
dan notis tersebut hendaklah dalam bahasa kebangsaan dan bahasa Inggeris.
(3) Jika agensi pelaporan kredit mempunyai suatu laman web, agensi pelaporan kredit itu hendaklah memaparkan dengan jelas dalam laman webnya suatu pernyataan yang menghuraikan maksud yang baginya agensi itu mengumpul maklumat kredit itu dan maksud yang baginya maklumat kredit itu akan diproses selanjutnya.
(4) Sesuatu agensi pelaporan kredit yang melanggar seksyen ini melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi lima ratus ribu ringgit atau dipenjarakan selama tempoh tidak melebihi dua tahun atau kedua-duanya.
