s 24 Disclosure of credit information

(1) No credit reporting agency shall disclose any credit information for any purpose or to any person unless— (a) the customer has given his consent to the disclosure; (b) the disclosure is necessary for the purpose of preventing or detecting crime or for the purpose of investigations; or (c) the disclosure is required or authorized by or under any law, or by the order of a court. (2) Subject to subsection (3), where a credit reporting agency has obtained the consent of the customer under paragraph (1)(a), it shall not disclose the credit information— (a) for any other purpose other than the purpose for which; or (b) to any other person other than the person to whom, the customer has consented under that paragraph. (3) Where a credit reporting agency intends to disclose the credit information— (a) for any other purpose other than the purpose for which the customer has consented to under paragraph (1)(a); or (b) to any other person other than the person to whom the customer has consented to under paragraph (1)(a), the credit reporting agency shall obtain the consent of the customer under paragraph (1)(a) to disclose the credit information for that other purpose or to that other person, as the case may be. (4) A credit reporting agency which contravenes this section commits an offence and shall, upon conviction, be liable to a fine not exceeding five hundred thousand ringgit or to imprisonment for a term not exceeding two years or to both.

Penzahiran maklumat kredit

(1) Tiada agensi pelaporan kredit boleh menzahirkan apa-apa maklumat kredit bagi apa-apa maksud atau kepada mana-mana orang melainkan jika— (a) pelanggan telah memberikan persetujuannya terhadap penzahiran itu; (b) penzahiran itu perlu bagi maksud menghalang atau mengesan jenayah atau bagi maksud penyiasatan; atau (c) penzahiran itu dikehendaki atau dibenarkan oleh atau di bawah mana-mana undang-undang, atau oleh perintah mahkamah. (2) Tertakluk pada subseksyen (3), jika suatu agensi pelaporan kredit telah mendapatkan persetujuan pelanggan di bawah perenggan (1)(a), agensi itu tidak boleh menzahirkan maklumat kredit itu— (a) bagi apa-apa maksud lain selain maksud yang baginya; atau (b) kepada mana-mana orang lain selain orang yang kepadanya, pelanggan itu telah memberikan persetujuan di bawah perenggan itu. (3) Jika suatu agensi pelaporan kredit berniat untuk menzahirkan maklumat kredit— (a) bagi apa-apa maksud lain selain maksud yang baginya pelanggan telah memberikan persetujuan di bawah perenggan (1)(a); atau (b) kepada mana-mana orang lain selain orang yang kepadanya pelanggan telah memberikan persetujuan di bawah perenggan (1)(a), agensi pelaporan kredit itu hendaklah mendapatkan persetujuan pelanggan di bawah perenggan (1)(a) untuk menzahirkan maklumat kredit itu bagi maksud lain itu atau kepada orang lain itu, mengikut mana-mana yang berkenaan. (4) Sesuatu agensi pelaporan kredit yang melanggar seksyen ini melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi lima ratus ribu ringgit atau dipenjarakan selama tempoh tidak melebihi dua tahun atau kedua-duanya.
