s 174 Investigation of business and affairs
(1) The conservator may require any of the persons mentioned in subsection (2), within twenty-one days thereof or such extended time as the conservator may permit, to verify and submit to the conservator a statement as to the business and affairs of the affected person in a form determined by the conservator containing—
(a) the particulars of the affected person’s assets and liabilities;
(b) the name and addresses of the creditors of the affected person;
(c) the securities held by the creditors of the affected person referred to in paragraph (1)(b);
(d) the dates when the securities referred to in paragraph (1)(c) were given;
(e) a statutory declaration made pursuant to the provisions of the *Statutory Declarations Act 1960 [Act 13], declaring the information in the statement of affairs as being true and correct; and
(f) such further or other information as may be required by the conservator.
(2) The conservator may require the following persons to verify and submit the statement of business and affairs referred to in subsection (1):
(a) persons who are or have been officers of the affected person;
(b) persons who have taken part in the formation of the affected person at any time within two years prior to the appointment of the conservator; or
(c) persons who are in the affected person’s employment or have been in the affected person’s employment within two years before the appointment of the conservator who, in the opinion of the conservator, have knowledge of the information required.
(3) The conservator may at any time release a person from any obligation imposed on him under subsection (1) or (2).
(4) The conservator shall, on completion of his functions and duties under this Act, return to the affected person any book, statement, record, account or other documents or anything referred to under subsection 173(1), this section and section 175.
(5) In this section, “employment” includes employment under a contract for services.

Penyiasatan urusan dan hal ehwal
(1) Konservator boleh menghendaki mana-mana orang yang disebut dalam subseksyen (2), dalam tempoh dua puluh satu hari dari tarikh itu atau apa-apa tempoh lanjutan sebagaimana yang dibenarkan oleh konservator, untuk menentusahkan dan mengemukakan kepada konservator suatu pernyataan tentang urusan dan hal ehwal orang terjejas dalam bentuk yang ditentukan oleh konservator yang mengandungi—
(a) butiran aset dan liabiliti orang terjejas;
(b) nama dan alamat pemiutang orang terjejas;
(c) cagaran yang dipegang oleh pemiutang orang terjejas yang disebut dalam perenggan (1)(b);
(d) tarikh cagaran yang disebut dalam perenggan (1)(c) telah diberikan;
(e) suatu akuan berkanun yang dibuat menurut peruntukan *Akta Akuan Berkanun 1960 [Akta 13], mengisytiharkan maklumat dalam pernyataan hal ehwal itu sebagai benar dan betul; dan
(f) apa-apa maklumat lanjut atau maklumat lain sebagaimana *CATATAN—Akta Akuan Berkanun 1960 [Akta 13] telah disemak dan dinamakan sebagai Akta Akuan Berkanun 1960 [Akta 783] m.b.p. 17 November 2016
yang dikehendaki oleh konservator.
(2) Konservator boleh menghendaki orang yang berikut supaya menentusahkan dan mengemukakan pernyataan urusan dan hal ehwal yang disebut dalam subseksyen (1):
(a) orang yang menjadi atau pernah menjadi pegawai orang terjejas;
(b) orang yang pernah mengambil bahagian dalam pembentukan orang terjejas pada bila-bila masa dalam tempoh dua tahun sebelum pelantikan konservator itu; atau
(c) orang yang dalam penggajian orang terjejas atau pernah berada dalam penggajian orang terjejas dalam tempoh dua tahun sebelum pelantikan konservator yang, pada pendapat konservator, mempunyai maklumat yang dikehendaki.
(3) Konservator boleh pada bila-bila masa melepaskan seseorang daripada apa-apa obligasi yang dikenakan ke atasnya di bawah subseksyen (1) atau (2).
(4) Konservator hendaklah, apabila fungsi dan kewajipannya di bawah Akta ini tamat, memulangkan kepada orang terjejas apa-apa buku, pernyataan, rekod, akaun atau dokumen lain atau apa-apa jua yang disebut di bawah subseksyen 173(1), seksyen ini dan seksyen 175.
(5) Dalam seksyen ini, “penggajian” termasuklah penggajian di bawah suatu kontrak untuk perkhidmatan.
