s 90 Application procedures for section 87, 88 or 89

(1) An application for an approval of— (a) the Bank under subsection 87(1); or (b) the Minister under subsection 87(2) or 88(1), or section 89, as the case may be, shall be made by submitting the application to the Bank together with such documents or information as may be specified by the Bank. (2) In assessing the suitability of an applicant for the purposes of— (a) granting an approval of the Bank under subsection 87(1); or (b) recommending to the Minister under subsection 87(2) or 88(1), the Bank shall take into consideration matters that the Bank considers relevant including any of the factors set out in Schedule 6, and any standards as may be specified by the Bank under subsection 91(1). (3) Upon making an assessment under subsection (2) and where the Bank is satisfied with the suitability of the applicant, the Bank— (a) may approve an application in respect of subsection 87(1), with or without conditions; or (b) may make a recommendation to the Minister to approve the application in respect of subsection 87(2) or 88(1), with or without conditions. (4) Where an application is made under subsection (1) for an approval of the Minister in respect of section 89, the Bank shall consider the application and may make a recommendation to the Minister to grant the approval if the Bank is of the opinion that it would not be detrimental to the safety and soundness of the licensed person. (5) The Bank shall notify the applicant in writing if the Bank does not make a recommendation to the Minister under paragraph (3)(b) or subsection (4). (6) Where the Bank makes a recommendation pursuant to paragraph (3)(b) or subsection (4), the Minister may approve the application, with or without conditions, or reject the application. (7) The Minister, on the recommendation of the Bank, in the case of an approval under subsection (6), or the Bank, in the case of an approval under paragraph (3)(a), may, at any time amend or revoke any condition imposed on such approval under subsection (6) or paragraph (3)(a), as the case may be. (8) The Bank shall notify the applicant of its decision under paragraph (3)(a) or the decision of the Minister under subsection (6), as the case may be. (9) The Bank may, at any time by notice in writing, require a person who has obtained the approval of the Bank under paragraph (3)(a) or the Minister under subsection (6) in respect of subsection 87(2) or 88(1), to submit any information or particulars of any share acquired or held directly or indirectly either for his own benefit or any other person. (10) Any person who has been served with a notice under subsection (9) shall submit to the Bank such information and particulars as may be specified by the Bank.

Tatacara permohonan bagi seksyen 87, 88 atau 89

(1) Suatu permohonan bagi suatu kelulusan oleh— (a) Bank di bawah subseksyen 87(1); atau (b) Menteri di bawah subseksyen 87(2) atau 88(1), atau seksyen 89, mengikut mana-mana yang berkenaan, hendaklah dibuat dengan mengemukakan permohonan itu kepada Bank berserta dengan apa-apa dokumen atau maklumat sebagaimana yang ditentukan oleh Bank. (2) Dalam menilai kesesuaian seseorang pemohon bagi maksud— (a) Bank memberikan suatu kelulusan di bawah subseksyen 87(1); atau (b) mengesyorkan kepada Menteri di bawah subseksyen 87(2) atau 88(1), Bank hendaklah memberi pertimbangan atas perkara yang Bank berpendapat adalah berkaitan termasuk apa-apa faktor yang dinyatakan dalam Jadual 6, dan mana-mana standard sebagaimana yang ditentukan oleh Bank di bawah subseksyen 91(1). (3) Apabila membuat suatu penilaian di bawah subseksyen (2) dan jika Bank berpuas hati dengan kesesuaian pemohon itu, Bank— (a) boleh meluluskan suatu permohonan berkenaan dengan subseksyen 87(1), dengan atau tanpa syarat; atau (b) boleh membuat suatu syor kepada Menteri untuk meluluskan permohonan itu berkenaan dengan subseksyen 87(2) atau 88(1), dengan atau tanpa syarat. (4) Jika suatu permohonan yang dibuat di bawah subseksyen (1) bagi suatu kelulusan Menteri berkenaan dengan seksyen 89, Bank hendaklah mempertimbangkan permohonan itu dan boleh membuat suatu syor kepada Menteri untuk memberikan kelulusan itu sekiranya Bank berpendapat bahawa ia tidak akan memudaratkan keselamatan dan kekukuhan orang berlesen itu. (5) Bank hendaklah memberitahu pemohon secara bertulis sekiranya Bank tidak membuat suatu syor kepada Menteri di bawah perenggan (3)(b) atau subseksyen (4). (6) Jika Bank membuat suatu syor menurut perenggan (3)(b) atau subseksyen (4), Menteri boleh meluluskan permohonan itu, dengan atau tanpa syarat, atau menolak permohonan itu. (7) Menteri, atas syor Bank, dalam hal suatu kelulusan di bawah subseksyen (6), atau Bank, dalam hal suatu kelulusan di bawah perenggan (3)(a), boleh, pada bila-bila masa meminda atau membatalkan apa-apa syarat yang dikenakan atas kelulusan itu di bawah subseksyen (6) atau perenggan (3)(a), mengikut manamana yang berkenaan. (8) Bank hendaklah memberitahu pemohon itu mengenai keputusannya di bawah perenggan (3)(a) atau keputusan Menteri di bawah subseksyen (6), mengikut mana-mana yang berkenaan. (9) Bank boleh, pada bila-bila masa melalui notis secara bertulis, menghendaki seseorang yang telah mendapat kelulusan Bank di bawah perenggan (3)(a) atau Menteri di bawah subseksyen (6) berkenaan dengan subseksyen 87(2) atau 88(1), untuk mengemukakan apa-apa maklumat atau butir apa-apa syer yang diperoleh atau dipegang secara langsung atau tidak langsung sama ada bagi faedahnya sendiri atau mana-mana orang lain. (10) Mana-mana orang yang telah disampaikan dengan suatu notis di bawah subseksyen (9) hendaklah mengemukakan kepada Bank apa-apa maklumat dan butir sebagaimana yang ditentukan oleh Bank.
