s 38 Credit for input tax against output tax

(1) Any taxable person is entitled to credit for so much of his input tax as is allowable under section 39 to be deducted from any output tax that is due from him. (2) For the purposes of any tax on a taxable supply of goods or services to a taxable person, any flat rate addition included in the consideration of any supply acquired by a registered person from the approved person under section 74 shall be treated as a tax on the supply. (3) Subject to subsections (4) and (5), where— (a) no output tax is due at the end of any taxable period; or (b) the amount of the credit entitled by virtue of subsection (1) to the taxable person exceeds the output tax, the amount of the credit or the amount of credit that exceeds the output tax, as the case may be, shall be refunded to the taxable person by the Director General. (4) The whole or any part of any input tax due as credit to any taxable person in any taxable period may be held over to be credited to any following or subsequent taxable period, either on the taxable person’s own application in writing or on any direction given by the Director General. (5) Where at the end of any taxable period any amount is due under subsection (3), the Director General may withhold payment of the amount if— (a) the taxable person fails to furnish the return under section 41 or to provide any information as required by the Director General; or (b) the Director General has reasonable grounds to believe that the amount should not be the amount due to the person. (6) No deduction shall be made under subsection (1) nor shall any refund be made under subsection (3), except on a claim made in the prescribed manner and within the prescribed time. (7) Where any taxable person has made no taxable supply during a taxable period or any previous taxable period, any refund to be made under subsection (3) shall be made subject to the conditions imposed by the Director General as he deems fit. (8) Subject to subsections (5) and (7), any refund to be made by the Director General under subsection (3) shall be made within the prescribed time. (9) Except as the Director General may otherwise allow— (a) where a taxable person fails to pay his supplier the consideration or any part thereof for the supply of any goods or services made by his supplier to him at the end of the period of six months following the date of supply; and (b) where the taxable person has credited under subsection (1) or been refunded under subsection (3) the input tax to which the consideration or the part thereof which he failed to pay relates, the taxable person shall account an amount equal to the input tax which shall be deemed as his output tax. (10) The taxable person shall account the amount deemed as output tax under subsection (9) in the taxable period after the period of six months has elapsed and in accordance with the method which he was required to use when he first credited the input tax and he shall repay the amount to the Director General at the same time as any tax in respect of the taxable period would be due and payable by him. (11) Where a taxable person— (a) has complied with subsection (10); and (b) pays his supplier the consideration or any part thereof for the supply of goods or services referred to in paragraph (9)(a), the taxable person shall be entitled to treat an amount equal to the input tax relating to the payment referred to in paragraph (b) as if it were an input tax for the taxable period during which the payment was made. (12) The whole or any part of tax charged on any supply of goods or services or importation of goods, as may be prescribed, shall be excluded from any credit under this section.

Kredit bagi cukai input terhadap cukai output

(1) Mana-mana orang kena cukai berhak kepada suatu kredit sebanyak mana cukai inputnya sebagaimana yang boleh dibenarkan di bawah seksyen 39 untuk dipotong daripada apa-apa cukai output yang kena dibayar olehnya. (2) Bagi maksud apa-apa cukai ke atas suatu pembekalan bercukai barang atau perkhidmatan kepada seseorang orang kena cukai, apa-apa tambahan kadar rata yang termasuk dalam balasan bagi apa-apa pembekalan yang diperoleh oleh orang berdaftar daripada orang yang diluluskan di bawah seksyen 74 hendaklah dikira sebagai suatu cukai ke atas pembekalan itu. (3) Tertakluk kepada subseksyen (4) dan (5), jika— (a) tiada cukai output yang kena dibayar pada akhir apa-apa tempoh bercukai; atau (b) amaun kredit yang orang kena cukai berhak kepadanya menurut kuasa subseksyen (1) melebihi cukai output, amaun kredit atau amaun kredit yang melebihi cukai output itu, mengikut mana-mana yang berkenaan, hendaklah dibayar balik kepada orang kena cukai itu oleh Ketua Pengarah. (4) Keseluruhan atau mana-mana bahagian cukai input yang genap masa sebagai kredit kepada mana-mana orang kena cukai dalam mana-mana tempoh bercukai boleh dipegang untuk dikreditkan kepada mana-mana tempoh bercukai yang berikutnya atau berturutan dengannya, sama ada atas permohonan secara bertulis orang kena cukai itu sendiri atau atas apa-apa arahan yang diberikan oleh Ketua Pengarah. (5) Jika pada akhir mana-mana tempoh bercukai apa-apa amaun adalah kena dibayar di bawah subseksyen (3), Ketua Pengarah boleh menahan pembayaran amaun itu jika— (a) orang kena cukai itu tidak memberikan penyata di bawah seksyen 41 atau menyediakan apa-apa maklumat sebagaimana yang dikehendaki oleh Ketua Pengarah; atau (b) Ketua Pengarah mempunyai alasan yang munasabah untuk mempercayai bahawa amaun itu bukan amaun yang kena dibayar kepada orang itu. (6) Tiada potongan boleh dibuat di bawah subseksyen (1) dan tiada apa-apa pembayaran balik boleh dibuat di bawah subseksyen (3), kecuali atas suatu tuntutan yang dibuat mengikut cara yang ditetapkan dan dalam masa yang ditetapkan. (7) Jika mana-mana orang kena cukai tidak membuat pembekalan bercukai dalam suatu tempoh bercukai atau mana-mana tempoh bercukai terdahulu, apa-apa pembayaran balik yang hendak dibuat di bawah subseksyen (3) hendaklah dibuat tertakluk kepada syarat yang dikenakan oleh Ketua Pengarah sebagaimana yang difikirkannya patut. (8) Tertakluk kepada subseksyen (5) dan (7), apa-apa pembayaran balik yang akan dibuat oleh Ketua Pengarah di bawah subseksyen (3) hendaklah dibuat dalam masa yang ditetapkan. (9) Kecuali sebagaimana yang dibenarkan selainnya oleh Ketua Pengarah, jika— (a) orang kena cukai tidak membayar pembekalnya balasan atau apa-apa bahagian daripada balasan itu bagi pembekalan apa-apa barang atau perkhidmatan yang dibuat oleh pembekalnya kepada orang kena cukai itu pada akhir tempoh enam bulan selepas tarikh pembekalan itu; dan (b) orang kena cukai itu telah mengkreditkan di bawah subseksyen (1) atau telah dibayar balik di bawah subseksyen (3) cukai input yang berhubungan dengan balasan atau bahagian daripada balasan itu yang tidak dibayar oleh orang kena cukai itu, orang kena cukai itu hendaklah mengakaunkan suatu amaun yang bersamaan dengan cukai input yang hendaklah disifatkan sebagai cukai outputnya. (10) Orang kena cukai hendaklah mengakaunkan amaun yang disifatkan sebagai cukai output di bawah subseksyen (9) dalam tempoh bercukai selepas tamatnya tempoh enam bulan itu dan mengikut cara yang dia dikehendaki untuk menggunakan semasa dia pertama kali mengkreditkan cukai input itu dan dia hendaklah membayar semula amaun itu kepada Ketua Pengarah pada masa yang sama sebagaimana apa-apa cukai berkenaan dengan tempoh bercukai yang akan genap masa dan kena dibayar olehnya. (11) Jika orang kena cukai— (a) telah mematuhi subseksyen (10); dan (b) membayar pembekalnya balasan atau apa-apa bahagian daripada balasan itu bagi pembekalan barang atau perkhidmatan yang disebut dalam perenggan (9)(a), orang kena cukai itu berhak untuk mengira suatu amaun yang bersamaan dengan cukai input yang berhubungan dengan pembayaran yang disebut dalam perenggan (b) seolah-olah amaun itu ialah suatu cukai input bagi tempoh bercukai yang dalamnya pembayaran itu dibuat. (12) Keseluruhan atau apa-apa bahagian cukai yang dikenakan ke atas apa-apa pembekalan barang atau perkhidmatan atau pengimportan barang, sebagaimana yang ditetapkan, hendaklah dikecualikan daripada apa-apa kredit di bawah seksyen ini.
