s 45 Transfer or assignment of licence or permit
(1) Subject to subsection (3), a licence or permit issued under this Part shall be personal to the licensee or permit holder and shall not be transferred or assigned.
(2) A licensee or permit holder who contravenes subsection (1) commits an offence and shall, on conviction, be liable to a fine not exceeding one million ringgit or to imprisonment for a term not exceeding three years or to both.
(3) Notwithstanding paragraph 43(1)(c), the Commission may, in the event of the liquidation of a licensee or a permit holder, where a
receiver or manager is appointed in relation to the business of such licensee or permit holder, or where for any reason the Commission is satisfied that it would be unjust not to do so, authorize the transfer of such licence or permit.

Pemindahmilikan atau penyerahhakan lesen atau permit
(1) Tertakluk kepada subseksyen (3), suatu lesen atau permit yang dikeluarkan di bawah Bahagian ini adalah khas untuk pemegang lesen atau pemegang permit dan tidak boleh dipindahmilikkan atau diserahhakkan.
(2) Seseorang pemegang lesen atau pemegang permit yang melanggar subseksyen (1) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi satu juta ringgit atau dipenjarakan selama tempoh tidak melebihi tiga tahun atau keduaduanya.
(3) Walau apa pun perenggan 43(1)(c), Suruhanjaya boleh, sekiranya terdapat penyelesaian seseorang pemegang lesen atau pemegang permit, jika penerima atau pengurus dilantik berhubung dengan perniagaan pemegang lesen atau pemegang permit itu, atau jika atas apa-apa sebab Suruhanjaya berpuas hati bahawa adalah tidak adil untuk tidak berbuat demikian, membenarkan pemindahmilikan lesen atau permit itu.
