s 46 Power to set charges
(1) The Commission shall regulate charges for aviation services.
(2) In carrying out its function under subsection (1), the Commission shall have the power to—
(a) set charges, including maximum charges, or establishing the method for determination of such charges for aviation services;
(b) carry out reviews of passenger service charges, landing fees and parking fees, third party ground handling charges and other charges for aviation services at such intervals as the Commission thinks fit; and
(c) following such reviews, revise any charges set or method established under paragraph (a) as the Commission thinks fit.
(3) For the purposes of paragraphs (2)(a) and (c), the Commission shall have regard to—
(a) the costs of supplying the aviation services;
(b) the need to promote competitive charges;
(c) any relevant benchmarks including international benchmarks for prices, costs and return on assets in comparable industries;
(d) the financial implications which may arise from the determination of the Commission;
(e) the consumer and investor interests;
(f) the return on assets for the licensees or permit holder; and
(g) any other factors the Commission considers relevant.
(4) The Commission shall publish all the charges determined by the Commission in the Gazette.

Kuasa untuk menetapkan caj
(1) Suruhanjaya hendaklah mengawal selia caj bagi perkhidmatan penerbangan.
(2) Dalam menjalankan fungsinya di bawah subseksyen (1), Suruhanjaya hendaklah mempunyai kuasa untuk—
(a) menetapkan caj, termasuk caj maksimum, atau mewujudkan kaedah bagi penentuan apa-apa caj bagi perkhidmatan penerbangan;
(b) menjalankan kajian semula bagi caj perkhidmatan penumpang, fi pendaratan dan fi parkir, caj pengendalian darat pihak ketiga dan apa-apa caj lain bagi perkhidmatan penerbangan pada apa-apa lat tempoh yang difikirkan patut oleh Suruhanjaya; dan
(c) berikutan apa-apa kajian semula itu, menyemak apa-apa caj yang telah ditetapkan atau kaedah yang diwujudkan di bawah perenggan (a) sebagaimana yang difikirkan patut oleh Suruhanjaya.
(3) Bagi maksud perenggan (2)(a) dan (c), Suruhanjaya hendaklah mengambil kira—
(a) kos membekalkan perkhidmatan penerbangan;
(b) keperluan untuk menggalakkan caj yang bersaing;
(c) apa-apa penanda aras yang berkaitan termasuklah penanda aras antarabangsa bagi harga, kos dan pulangan atas aset dalam industri yang setanding;
(d) implikasi kewangan yang mungkin berbangkit daripada penentuan Suruhanjaya;
(e) kepentingan pengguna dan pelabur;
(f) pulangan atas aset bagi pemegang lesen atau pemegang permit; dan
(g) apa-apa faktor lain yang difikirkan berkaitan oleh Suruhanjaya.
(4) Suruhanjaya hendaklah menyiarkan semua caj yang ditentukan oleh Suruhanjaya dalam Warta.
