s 53 Abuse of dominant position is prohibited
(1) An enterprise is prohibited from engaging, whether independently or collectively, in any conduct which amounts to an abuse of a dominant position in any aviation service market.
(2) The Commission may publish guidelines specifying the types of conduct which would or would not be prohibited under subsection (1).
(3) This section does not prohibit an enterprise in a dominant position from taking any step which has reasonable commercial justification or represents a reasonable commercial response to the market entry or market conduct of a competitor.
(4) The fact that the market share of any enterprise is above or below any particular level shall not in itself be regarded as conclusive as to whether that enterprise occupies, or does not occupy, a dominant position in that market.

Penyalahgunaan kedudukan dominan dilarang
(1) Suatu perusahaan dilarang untuk terlibat, sama ada secara sendirian atau kolektif, dalam apa-apa perlakuan yang berupa suatu penyalahgunaan kedudukan dominan dalam mana-mana pasaran perkhidmatan penerbangan.
(2) Suruhanjaya boleh menyiarkan garis panduan yang menyatakan jenis perlakuan yang akan atau tidak dilarang di bawah subseksyen (1).
(3) Seksyen ini tidak melarang suatu perusahaan yang berada dalam kedudukan dominan daripada mengambil apa-apa langkah yang mempunyai justifikasi komersial yang munasabah atau merupakan suatu respons komersial yang munasabah terhadap kemasukan ke dalam pasaran atau perlakuan pasaran seorang pesaing.
(4) Hakikat bahawa bahagian pasaran mana-mana perusahaan adalah mengatasi atau di bawah apa-apa peringkat tertentu tidak dengan sendirinya boleh dianggap sebagai konklusif tentang sama ada perusahaan itu berada, atau tidak berada, pada suatu kedudukan dominan dalam pasaran itu.
