s 28 Interim orders

(1) Where, based on the findings of the Investigating Committee and the Disciplinary Authority, the Council is satisfied that it is necessary for the protection of the members of the public or is otherwise in the public interest, the Council may order the following: (a) that the registration of such registered practitioner be suspended for such period not exceeding twelve months as may be specified in the order which shall be known as an interim suspension order; or (b) that the registration of such registered practitioner be continued on his compliance of such conditions as the Council thinks fit to impose, during such period not exceeding twelve months, as may be specified in the order which shall be known as an order for interim restricted registration. (2) The Council may extend or further extend an order made under subsection (1) and each extension shall be for a period not exceeding six months. (3) The Registrar shall notify the registered practitioner of the order made under subsections (1) and (2). (4) The Council may, upon application by the registered practitioner concerned— (a) in the case of an interim suspension order, revoke the order; (b) in the case of an order for interim restricted registration, revoke the order or vary any condition imposed by the order; or (c) in either case in paragraph (a) or (b), substitute for the period specified in the order or in the order extending it with any other period which could have been specified in the order or in the order extending it, when such order was made. (5) An interim suspension order or an order for interim restricted registration shall be in force until the end of the period specified in the order or, if extended under subsection (2), in the order extending it or, the date on which proceedings are concluded, whichever is the earlier. (6) While a person’s registration is suspended by virtue of an interim suspension order, he shall not be regarded as being registered notwithstanding that his name still appears in the Register. (7) Immediately upon the expiry or revocation of the interim suspension order or an order for interim restricted registration, the person’s rights and privileges as a registered practitioner shall be revived from the date of such expiry or revocation, provided that he has complied with all the terms of the order. (8) Any registered practitioner who contravenes the interim suspension order or the order for interim restricted registration imposed on him commits an offence. (9) Any registered practitioner who is aggrieved by any order made under this section may appeal to the Minister, and the decision of the Minister shall be final.

Perintah sementara

(1) Jika, berdasarkan dapatan Jawatankuasa Penyiasat dan Pihak Berkuasa Tatatertib, Majlis berpuas hati adalah perlu bagi perlindungan orang awam atau selainnya demi kepentingan awam, Majlis boleh membuat perintah yang berikut: (a) supaya pendaftaran pengamal berdaftar itu digantung bagi tempoh yang tidak melebihi dua belas bulan sebagaimana yang dinyatakan dalam perintah yang hendaklah dikenali sebagai perintah penggantungan sementara; atau (b) supaya pendaftaran pengamal berdaftar itu diteruskan atas kepatuhannya terhadap apa-apa syarat yang difikirkan patut oleh Majlis untuk dikenakan, sepanjang tempoh masa yang tidak melebihi dua belas bulan, sebagaimana yang dinyatakan dalam perintah yang hendaklah dikenali sebagai perintah bagi sekatan pendaftaran sementara. (2) Majlis boleh melanjutkan atau melanjutkan seterusnya suatu perintah yang dibuat di bawah subseksyen (1) dan setiap pelanjutan hendaklah bagi suatu tempoh tidak melebihi enam bulan. (3) Pendaftar hendaklah memberitahu pengamal berdaftar tentang perintah yang dibuat di bawah subseksyen (1) dan (2). (4) Majlis boleh, atas permohonan pengamal berdaftar berkenaan— (a) dalam hal perintah penggantungan sementara, membatalkan perintah itu; (b) dalam hal perintah bagi sekatan pendaftaran sementara, membatalkan perintah itu atau mengubah apa-apa syarat yang dikenakan oleh perintah itu; atau (c) dalam mana-mana hal dalam perenggan (a) atau (b), menggantikan tempoh yang dinyatakan dalam perintah atau dalam perintah yang melanjutkannya dengan tempoh lain yang dinyatakan dalam perintah itu atau perintah yang melanjutkannya itu, semasa perintah itu dibuat. (5) Suatu perintah penggantungan sementara atau perintah bagi sekatan pendaftaran sementara hendaklah berkuat kuasa sehingga berakhirnya tempoh yang dinyatakan dalam perintah itu atau, jika dilanjutkan di bawah subseksyen (2), dalam perintah pelanjutan itu atau, tarikh tamatnya prosiding, yang mana lebih awal. (6) Semasa pendaftaran seseorang digantung oleh sebab suatu perintah penggantungan sementara, dia tidak boleh disifatkan sebagai berdaftar walaupun namanya masih terdapat dalam Daftar. (7) Sebaik sahaja tamat tempoh atau pembatalan perintah penggantungan sementara atau perintah bagi sekatan pendaftaran sementara, hak dan keistimewaan orang itu sebagai pengamal berdaftar hendaklah dikembalikan semula dari tarikh tamat tempoh atau pembatalan itu, dengan syarat dia telah mematuhi semua terma perintah itu. (8) Mana-mana pengamal berdaftar yang melanggar perintah penggantungan sementara atau perintah bagi sekatan pendaftaran sementara yang dikenakan ke atasnya melakukan suatu kesalahan. (9) Mana-mana pengamal berdaftar yang terkilan dengan suatu perintah yang dibuat di bawah seksyen ini boleh merayu kepada Menteri, dan keputusan Menteri adalah muktamad.
