s 37 Disciplinary punishments

(1) The Council may, in the exercise of its disciplinary jurisdiction, impose any of the following punishment: (a) reprimand such registered practitioner; (b) order such registered practitioner’s registration to be subjected to conditions which may include, but are not limited to, one or more of the following: (i) that such conditions relating to the registered practitioner ’s practice area as it considers appropriate, be imposed on the registration of such registered practitioner; (ii) that such registered practitioner undergo educational courses or programmes as may be specified by the Council; or (iii) that such registered practitioner report on his practice area to such registered practitioner or persons as may be specified by the Council; (c) order the name of such registered practitioner to be suspended from the Register for such period as it thinks fit; or (d) make such order in paragraph (c) but suspend the application thereof, subject to such conditions as the Council may think fit, for a period, in the aggregate, not exceeding two years; (e) order the name of such registered practitioner to be struck off the register. (2) No registered practitioner shall practise as registered practitioner during the period of suspension under paragraph (1)(c). (3) The Council may also impose a fine as may be decided by the Council in addition to the punishments in subsection (1). (4) Any registered practitioner who contravenes the additional conditions imposed in paragraph (1)(c) or continues to practice during the period of suspension under paragraph (1)(c), or fails to pay the fine imposed under subsection (3) shall be subject to further disciplinary proceeding. (5) Any further disciplinary proceeding under subsection (4) relating to the failure to pay the fine imposed under subsection (3) shall not effect the right of the Council to recover such fine as a civil debt. (6) The Council may, in any case, make such order as the Council thinks fit with regard to the payment of the costs of the Registrar and of any complainant or of a registered practitioner, and any costs awarded may be recovered as a civil debt.

Hukuman tatatertib

(1) Majlis boleh, pada menjalankan bidang kuasa tatatertibnya, mengenakan mana-mana hukuman yang berikut: (a) mencela pengamal berdaftar berkenaan; (b) memerintahkan supaya pendaftaran pengamal berdaftar berkenaan dijadikan tertakluk kepada syarat termasuk, tetapi tidak terhad kepada, satu daripada yang berikut atau lebih: (i) apa-apa syarat yang berhubungan dengan bidang amalan pengamal berdaftar berkenaan yang difikirkan sesuai oleh Majlis dikenakan ke atas pendaftaran pengamal berdaftar berkenaan; (ii) supaya pengamal berdaftar menjalani kursus atau pembelajaran sebagaimana yang ditetapkan oleh Majlis; atau (iii) supaya pengamal berdaftar berkenaan melaporkan mengenai bidang amalannya kepada mana-mana pengamal berdaftar atau orang yang ditetapkan oleh Majlis; (c) memerintahkan supaya nama pengamal berdaftar berkenaan digantung daripada daftar bagi apa-apa tempoh yang difikirkan patut oleh Majlis; atau (d) membuat apa-apa perintah dalam perenggan (c) tetapi menangguhkan pelaksanaannya, tertakluk kepada apaapa syarat yang difikirkan patut oleh Majlis, bagi suatu tempoh, yang agregatnya, tidak melebihi dua tahun; (e) memerintahkan supaya nama pengamal berdaftar berkenaan dipotong daripada daftar. (2) Tiada seorang pun pengamal berdaftar boleh mengamal sebagai pengamal berdaftar semasa tempoh penggantungan di bawah perenggan (1)(c). (3) Majlis boleh mengenakan denda sebagaimana yang diputuskan oleh Majlis sebagai tambahan kepada hukuman di bawah subseksyen (1). (4) Mana-mana pengamal berdaftar yang tidak mematuhi apaapa syarat tambahan yang dikenakan di bawah perenggan (1)(b) atau meneruskan amalan dalam tempoh penggantungan di bawah perenggan (1)(c), atau tidak membayar denda yang dikenakan di bawah subseksyen (3) adalah tertakluk kepada prosiding tatatertib selanjutnya. (5) Apa-apa prosiding tatatertib selanjutnya di bawah subseksyen (4) berhubung dengan denda yang dikenakan di bawah subseksyen (3) yang tidak dibayar tidak menyentuh hak Majlis untuk menuntut denda itu sebagai hutang sivil. (6) Majlis boleh, dalam mana-mana hal, membuat apa-apa perintah yang difikirkan patut oleh Majlis berkaitan dengan pembayaran kos kepada Pendaftar dan mana-mana pengadu atau seseorang pengamal berdaftar, dan apa-apa kos yang diawardkan boleh dituntut sebagai hutang sivil.
