Traditional and Complementary Medicine Act 2016 s 58

s 58 List of document, record, etc., seized

(1) Except as provided in subsection (2), where any document, record, manual, book, material or other article is seized pursuant to this Act, the authorized officer making the seizure— (a) shall prepare and sign— (i) a list of the document, record, manual, book, material or other article seized; and (ii) a written notice of the seizure containing the grounds for the seizure; and (b) shall as soon as practicable serve a copy of the list of the document, record, manual, book, material or other article seized and the written notice of the seizure under paragraph (a) to the occupier of the premises which have been searched or to his agent or servant at those premises. (2) The written notice of the seizure shall not be required to be served in pursuance of paragraph (1)(b) where the seizure is made in the presence of the person against whom proceedings under this Act are intended to be taken, or in the presence of the owner of such property or his agent.

Senarai dokumen, rekod, dsb., yang dirampas

(1) Kecuali sebagaimana yang diperuntukkan dalam subseksyen (2), jika apa-apa dokumen, rekod, manual, buku, bahan atau artikel lain yang dirampas menurut Akta ini, pegawai diberi kuasa yang membuat rampasan— (a) hendaklah menyediakan dan menandatangani— (i) suatu senarai dokumen, rekod, manual, buku, bahan atau artikel lain yang dirampas itu; dan (ii) suatu notis rampasan bertulis yang mengandungi alasan untuk rampasan itu; dan (b) hendaklah dengan seberapa segera yang praktik menyampaikan salinan senarai dokumen, rekod, manual, buku, bahan atau artikel lain yang dirampas dan notis rampasan bertulis di bawah perenggan (a) kepada penghuni premis yang diperiksa atau kepada agen atau pekerja premis itu. (2) Notis rampasan bertulis tidak perlu disampaikan menurut perenggan (1)(b) jika rampasan dibuat dengan kehadiran orang yang ke atasnya prosiding di bawah Akta ini hendak diambil, atau dengan kehadiran pemilik harta itu atau agennya.
