s 59 Release of document, record, etc., seized

(1) If any document, record, manual, book, material or other article has been seized under this Act, the authorized officer who effected the seizure may, after referring to the Public Prosecutor, release the document, record, manual, book, material or other article has been seized to the person as he determines to be lawfully entitled to it, and is not otherwise required for the purpose of any proceedings under this Act or for the purpose of any prosecution under any other written law, and in such event neither the authorized officer effecting the seizure nor the Federal Government, shall be liable to any proceedings by any person if the seizure and the release of the document, record, manual, book, material or other article had been effected in good faith. (2) A record in writing shall be made by the authorized officer effecting the release of the document, record, manual, book, material or other article under subsection (1), specifying in detail the circumstances of and the reason for the release, and he shall send a copy of the record to the Public Prosecutor within seven days of the release.

Pelepasan dokumen, rekod, dsb., yang dirampas

(1) Jika apa-apa dokumen, rekod, manual, buku, bahan atau artikel lain yang dirampas di bawah Akta ini, pegawai diberi kuasa yang melakukan rampasan hendaklah, selepas merujuk kepada Pendakwa Raya, melepaskan dokumen, rekod, manual, buku, bahan atau artikel lain yang dirampas kepada orang yang dia tetapkan sebagai sah dimiliki, dan sebaliknya tidak diperlukan bagi tujuan apa-apa prosiding di bawah Akta ini atau untuk tujuan apa-apa pendakwaan di bawah mana-mana undang-undang bertulis lain, dan dalam keadaan di mana pegawai diberi kuasa yang melakukan rampasan dan juga Kerajaan Persekutuan, hendaklah bertanggungjawab kepada apa-apa prosiding oleh mana-mana orang jika rampasan dan pengeluaran dokumen, rekod, manual, buku, bahan atau artikel lain telah dilakukan dengan suci hati. (2) Suatu rekod bertulis hendaklah dibuat oleh pegawai diberi kuasa yang melakukan pelepasan dokumen, rekod, manual, buku, bahan atau artikel lain di bawah subseksyen (1), menyatakan dengan lengkap keadaan dan alasan untuk pelepasan, dan dia hendaklah menghantar satu salinan rekod itu kepada Pendakwa Raya dalam masa tujuh hari selepas pelepasan.
