(1) Prior to the registration of a scheme under section 9, a management company shall, subject to section 23, appoint a trustee to act for the interest holders.
(2) The appointment of a trustee by the management company shall be subject to the approval of the Registrar.
(3) In granting his approval under subsection (2), the Registrar may, having regard to the nature of the contract, arrangement,
undertaking or enterprise, to which a trust deed or contractual agreement relates, impose on the trustee such terms and conditions as he thinks fit.

Pelantikan pemegang amanah
(1) Sebelum pendaftaran suatu skim di bawah seksyen 9, syarikat pengurusan hendaklah, tertakluk kepada seksyen 23, melantik pemegang amanah untuk bertindak bagi pemegang kepentingan.
(2) Pelantikan pemegang amanah itu oleh syarikat pengurusan hendaklah tertakluk kepada kelulusan Pendafar.
(3) Apabila memberikan kelulusannya di bawah subseksyen (2), Pendaftar boleh, dengan mengambil kira jenis kontrak, perkiraan, aku janji atau perusahaan, yang berhubung dengan surat ikatan amanah atau perjanjian kontraktual itu, mengenakan apa-apa terma dan syarat ke atas pemegang amanah yang difikirkan patut oleh Pendaftar.
