s 54 Duty of auditor to disclose irregularity or undesirable practice
(1) Every auditor shall—
(a) in the course of performance of his duties as an auditor of a scheme, report to the management company—
(i) any irregularity or undesirable practice in the administration of the scheme which has come to his knowledge; or
(ii) any serious offence involving fraud or dishonesty has which been committed by the officers of the management company; and
(b) submit a copy of such report to the Registrar if there is reasonable cause to believe that such report is or might be of material significance to the Registrar.
(2) For the purposes of this section—
(a) a report is of material significance to the Registrar if it deals with a matter which, because of its nature or potential financial impact, has caused or is likely to cause financial loss to the scheme or any of its interest holders or creditors; and
(b) “a serious offence involving fraud or dishonesty” means an offence that is punishable by imprisonment for a term that is not less than two years or the value of the assets derived or likely to be derived or any loss suffered by the scheme, management company or interest holder from
the commission of such offence exceeds two hundred and fifty thousand ringgit.
(3) An auditor who contravenes this section commits an offence and shall, on conviction, be liable to imprisonment for a term not exceeding five years or to a fine not exceeding three million ringgit or to both.

Kewajipan juruaudit untuk menzahirkan amalan ketidakteraturan atau amalan yang tidak wajar
(1) Taip-tiap juruaudit hendaklah—
(a) dalam melaksanakan tanggungjawabnya sebagai seorang juruaudit suatu skim, melaporkan kepada syarikat pengurusan—
(i) apa-apa amalan ketidakteraturan atau amalan yang tidak wajar dalam pentadbiran skim yang sampai kepada pengetahuannya; atau
(ii) apa-apa kesalahan serius yang melibatkan fraud atau ketidakjujuran yang telah dilakukan oleh pegawai syarikat pengurusan itu; dan
(b) mengemukakan suatu salinan laporan itu kepada Pendaftar jika terdapat sebab yang munasabah untuk mempercayai bahawa laporan itu adalah atau mungkin menjadi kepentingan material kepada Pendaftar.
(2) Bagi maksud seksyen ini—
(a) suatu laporan menjadi kepentingan material kepada Pendaftar jika laporan itu menguruskan suatu perkara yang, kerana sifat atau potensi kesan kewangan, telah menyebabkan atau mungkin menyebabkan kerugian kewangan kepada skim atau mana-mana pemegang kepentingan atau pemiutang; dan
(b) “kesalahan serius yang melibatkan fraud atau ketidakjujuran” ertinya suatu kesalahan yang boleh dihukum dengan pemenjaraan selama tempoh tidak kurang daripada dua tahun atau nilai aset yang diperoleh atau boleh diperoleh atau apa-apa kerugian yang ditanggung oleh skim, syarikat pengurusan atau pemegang kepentingan daripada pelakuan kesalahan itu melebihi dua ratus lima puluh ribu ringgit.
(3) Seseorang juruaudit yang melanggar seksyen ini melakukan suatu kesalahan dan boleh, apabila disabitkan, dipenjarakan selama tempoh tidak melebihi lima tahun atau didenda tidak melebihi tiga juta ringgit atau kedua-duanya.
