s 15 Application for permit for non-commercial purpose

(1) Any person who intends to access a biological resource or traditional knowledge associated with a biological resource, including through an authorized intermediary for non-commercial purpose shall apply for a permit to the relevant Competent Authority in the form and manner as may be prescribed and shall be accompanied with a copy of a statutory declaration duly completed as specified in the Second Schedule and payment of the prescribed fee. (2) Any activity undertaken under subsection (1) shall be in collaboration with a public higher education institution, public research institution or Government agency, unless the relevant Competent Authority is satisfied that— (a) the applicant is a non-profit organization based or registered in Malaysia; (b) local researchers are involved in the activity; and (c) a program for capacity building is included in the activity. (3) The Competent Authority may, after receiving the application under subsection (1), approve the application, if the following matters have been satisfied: (a) the application is not for commercial or potential commercial purpose; (b) in the case of access to a biological resource or traditional knowledge associated with a biological resource, as the case may be, the applicant has obtained the prior informed consent in accordance with section 23; (c) the application is not for any threatened taxa; (d) the application is not for any endemic species, rare species or any species protected under any Federal or State law; (e) the access is not likely to result in adverse effects on the livelihood or cultural practices including religious, ceremonial or other traditional or customary practices of indigenous community and local community; (f) in the case of access to human genetic resource, its use is not for the purposes contrary to ethical values or the public interest; (g) the access may not result in adverse environmental impact which may be difficult to control and mitigate; (h) the access may not cause genetic erosion or affect any function of the ecosystem; (i) the access may not adversely affect food security; (j) the use of the biological resource is not for the purposes contrary to the national or State interest; (k) the use of the biological resource is not for the development of biological or chemical weapons, or for military or terrorist purposes; (l) the use of the biological resource is not for the purposes associated with genetic use restriction technology; (m) the applicant has not committed an offence under this Act; (n) the applicant has not been adjudicated a bankrupt or, in the case of a company, has not been wound up; (o) the application complies with the requirements of this Act or any other written law; and (p) the use of the biological resources is not contrary to related international agreements or instruments to which Malaysia is a party. (4) The Competent Authority shall refuse the application if— (a) any of the grounds specified in subsection (3) is not fulfilled; or (b) after consultation with the National Competent Authority, the applicant is from, or otherwise based or operating in, jurisdictions which do not provide for adequate and effective measures that requires biological resources utilized within its jurisdiction to be accessed in accordance with prior informed consent and that mutually agreed terms to be established as provided under this Act. (5) Notwithstanding subsection (4), the Competent Authority may issue a permit relating to paragraphs (3)(c) and (d) if the Competent Authority is satisfied that the application for permit does not undermine the conservation and sustainable use of biodiversity. (6) After giving due consideration to the application under subsections (1) and (3), the Competent Authority may— (a) approve the application, with or without condition, and issue a permit to the applicant; or (b) refuse the application, stating the grounds for refusal. (7) Any person who accesses a biological resource or traditional knowledge associated with a biological resource without a permit under subsection (1) or contravenes any condition imposed on the permit under subsection (6) commits an offence and shall, on conviction, be liable— (a) where such person is an individual, to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding seven years or to both; or (b) where such person is a body corporate, to a fine not exceeding one million ringgit.

Permohonan permit bagi maksud bukan komersial

(1) Mana-mana orang yang berniat untuk mengakses sumber biologi atau pengetahuan tradisi yang berkaitan dengan sumber biologi, termasuk melalui suatu pengantara yang diberi kuasa bagi maksud bukan komersial hendaklah memohon permit kepada Pihak Berkuasa Kompeten yang berkenaan dalam bentuk dan cara sebagaimana yang ditetapkan dan hendaklah disertai dengan suatu salinan akuan berkanun yang dilengkapkan dengan sempurna sebagaimana yang dinyatakan dalam Jadual Kedua dan bayaran fi yang ditetapkan. (2) Apa-apa aktiviti yang dijalankan di bawah subseksyen (1) hendaklah dijalankan dengan kerjasama dengan suatu institusi pengajian tinggi awam, institusi penyelidikan awam atau agensi Kerajaan, melainkan jika Pihak Berkuasa Kompeten yang berkenaan berpuas hati bahawa— (a) pemohon ialah suatu pertubuhan bukan berasaskan keuntungan yang berpangkalan atau didaftarkan di Malaysia; (b) penyelidik tempatan terlibat dalam aktiviti itu; dan (c) suatu program untuk membina keupayaan dimasukkan dalam aktiviti. (3) Pihak Berkuasa Kompeten boleh, selepas menerima permohonan di bawah subseksyen (1), meluluskan permohonan itu, jika perkara yang berikut telah dipenuhi: (a) permohonan bukan bagi maksud komersial atau komersial berpotensi; (b) dalam hal akses kepada sumber biologi atau pengetahuan tradisi yang berkaitan dengan sumber biologi, mengikut mana-mana yang berkenaan, pemohon telah mendapat keizinan termaklum awal mengikut seksyen 23; (c) permohonan itu bukan bagi apa-apa taksa yang terancam; (d) permohonan itu bukan bagi apa-apa spesies yang endemik, spesies nadir atau apa-apa spesies yang dilindungi di bawah undang-undang Persekutuan atau Negeri; (e) akses itu tidak mungkin mendatangkan kesan buruk terhadap punca pencarian atau amalan budaya termasuk amalan keagamaan, istiadat atau tradisi atau adat lain masyarakat pribumi dan masyarakat tempatan lain; (f) dalam hal akses kepada sumber genetik manusia, penggunaannya bukan bagi maksud yang bertentangan dengan nilai-nilai etika atau kepentingan awam; (g) akses itu tidak boleh mendatangkan kesan buruk terhadap alam sekitar yang mungkin sukar untuk dikawal dan dikurangkan; Akses kepada Sumber Biologi dan Perkongsian Faedah 25 (h) akses itu tidak boleh mengakibatkan hakisan genetik atau menjejaskan apa-apa fungsi ekosistem; (i) akses itu tidak boleh menjejaskan keselamatan makanan; (j) penggunaan sumber biologi itu bukanlah bagi maksud yang bertentangan dengan kepentingan negara atau Negeri; (k) penggunaan sumber biologi itu bukanlah untuk membangunkan senjata biologi atau kimia, atau bagi maksud ketenteraan atau keganasan; (l) penggunaan sumber biologi itu bukanlah bagi maksud yang berkaitan dengan teknologi pembatasan penggunaan genetik; (m) pemohon tidak melakukan suatu kesalahan di bawah Akta ini; (n) pemohon tidak dihukum bankrap atau, dalam hal suatu syarikat, tidak digulungkan; (o) permohonan itu mematuhi kehendak Akta ini atau mana-mana undang-undang bertulis lain; dan (p) penggunaan sumber biologi itu tidak bertentangan dengan perjanjian antarabangsa atau instrumen yang berkaitan yang kepadanya Malaysia menjadi suatu pihak. (4) Pihak Berkuasa Kompeten hendaklah menolak permohonan itu jika— (a) apa-apa alasan yang dinyatakan dalam subseksyen (3) tidak dipenuhi; atau (b) selepas berunding dengan Pihak Berkuasa Kompeten Kebangsaan, pemohon berasal dari, atau selainnya berpangkalan atau beroperasi dalam, bidang kuasa yang tidak memperuntukkan langkah-langkah yang mencukupi dan berkesan yang menghendaki sumber biologi digunakan dalam bidang kuasanya hendaklah diakses mengikut keizinan termaklum awal dan terma dipersetujui bersama hendaklah dibuat sebagaimana yang diperuntukkan di bawah Akta ini. (5) Walau apa pun subseksyen (4), Pihak Berkuasa Kompeten boleh mengeluarkan permit yang berhubungan dengan perenggan (3)(c) dan (d) jika Pihak Berkuasa Kompeten berpuas hati bahawa permohonan bagi permit itu tidak menjejaskan pemuliharaan dan penggunaan biodiversiti secara mampan. (6) Selepas memberikan pertimbangan yang sewajarnya kepada permohonan di bawah subseksyen (1) dan (3), Pihak Berkuasa Kompeten boleh— (a) meluluskan permohonan, dengan atau tanpa syarat, dan mengeluarkan suatu permit kepada pemohon; atau (b) menolak permohonan, dengan menyatakan alasan bagi penolakan. (7) Mana-mana orang yang mempunyai akses kepada sumber biologi atau pengetahuan tradisi yang berkaitan dengan sumber biologi tanpa permit di bawah subseksyen (1) atau melanggar apa-apa syarat yang dikenakan ke atas permit di bawah subseksyen (6) melakukan suatu kesalahan dan boleh, apabila disabitkan— (a) jika orang itu ialah orang perseorangan, didenda tidak melebihi satu ratus ribu ringgit atau dipenjarakan selama tempoh tidak melebihi tujuh tahun atau kedua-duanya; atau (b) jika orang itu ialah suatu pertubuhan perbadanan, didenda tidak melebihi satu juta ringgit.
