Employment Insurance System Act 2017 s 60

s 60 Institution of proceedings, etc.

(1) All proceedings before the Appellate Board shall be instituted in the Appellate Board established for the area in which the insured person was working at the time of the question, dispute, claim or appeal arises. (2) The Chairman of the Appellate Board may, upon application made by the parties to the Appellate Board, transfer any matter pending before him in a State or area to any other Appellate Board in another State or area and shall give his reasons for allowing or not allowing the application for transfer. (3) The Appellate Board to which any matter or proceedings is transferred under subsection (2) shall continue to decide on the matter or proceedings as if the matter or proceedings had been originally instituted in such Appellate Board.

Memulakan prosiding, dsb.

(1) Semua prosiding di hadapan Jemaah Rayuan hendaklah dimulakan di hadapan Jemaah Rayuan yang ditubuhkan bagi kawasan di mana orang berinsurans itu bekerja pada masa persoalan, pertikaian, tuntutan atau rayuan timbul. (2) Pengerusi Jemaah Rayuan boleh, apabila permohonan dibuat oleh pihak-pihak kepada Jemaah Rayuan, memindahkan apa-apa perkara yang belum selesai di hadapannya di suatu Negeri atau kawasan kepada mana-mana Jemaah Rayuan lain di Negeri atau kawasan lain dan hendaklah memberikan sebabnya bagi membenarkan atau tidak membenarkan permohonan untuk pemindahan itu. (3) Jemaah Rayuan yang kepadanya apa-apa perkara atau prosiding dipindahkan di bawah subseksyen (2) hendaklah meneruskan untuk memutuskan perkara atau prosiding itu seolah-olah perkara atau prosiding itu telah dimulakan pada asalnya di hadapan Jemaah Rayuan itu.
