Employment Insurance System Act 2017 s 61

s 61 Commencement of proceedings

(1) The proceedings before an Appellate Board in respect of any question, dispute, claim or appeal referred to in section 59 shall be commenced by an application in the manner as prescribed. (2) Every application under subsection (1) shall be made within sixty days from the date on which the cause of action arises. (3) For the purpose of subsection (2)— (a) the cause of action in respect of a claim for benefits shall be deemed to arise from the date the insured person received the written decision of the Organization on such claim; and (b) the cause of action in respect of any claim by the Organization for recovering contributions from an employer shall be deemed to arise from the date of the evidence of contributions payable is due to be received by the Organization.

(1) Prosiding di hadapan Jemaah Rayuan berkenaan dengan apaapa persoalan, pertikaian, tuntutan atau rayuan yang disebut dalam seksyen 59 hendaklah dimulakan dengan suatu permohonan mengikut cara sebagaimana yang ditetapkan. (2) Tiap-tiap permohonan di bawah subseksyen (1) hendaklah dibuat dalam masa enam puluh hari dari tarikh kausa tindakan itu timbul. (3) Bagi maksud subseksyen (2)— (a) kausa tindakan berkenaan dengan tuntutan bagi faedah hendaklah disifatkan telah timbul dari tarikh orang berinsurans itu menerima keputusan bertulis daripada Pertubuhan mengenai tuntutan itu; dan (b) kausa tindakan berkenaan dengan apa-apa tuntutan oleh Pertubuhan untuk mendapatkan balik caruman daripada majikan hendaklah disifatkan telah timbul dari tarikh keterangan mengenai caruman yang kena dibayar yang genap masa untuk diterima oleh Pertubuhan.
