s 75 Production of certificate of analysis

(1) In any prosecution under this Act, a certificate of analysis purporting to be under the hand of an analyst shall, on the production of the certificate by the Public Prosecutor, be sufficient evidence of the facts stated in the certificate unless the accused requires that the analyst be called as a witness, in which case he shall give notice thereof to the Public Prosecutor not less than three clear days before the commencement of the trial. (2) Where the Public Prosecutor intends to give in evidence any certificate of analysis, he shall deliver a copy of the certificate to the accused not less than ten clear days before the commencement of the trial. (3) Analysts are bound to state the truth in the certificate of analysis under their hands. (4) In this section, “analyst” means— (a) a registered chemist under the Chemists Act 1975 [Act 158] or a person authorized under section 23a of such Act, or his employee working under his supervision; (b) a registered pharmacist under the Registration of Pharmacists Act 1951 [Act 371] or his employee working under his supervision; (c) a registered engineer under the Registration of Engineers Act 1967 [Act 138]; or (d) a registered geologist under the Geologists Act 2008 [Act 689]. (5) If an analyst is called as a witness by the accused under subsection (1), the analyst shall be called at the expense of the accused unless the court otherwise directs. (6) The Minister may appoint any qualified person or class of qualified persons, by notification in the Gazette, to be an analyst for the purpose of this section.

Pengemukaan perakuan analisis

(1) Dalam apa-apa pendakwaan di bawah Akta ini, suatu perakuan analisis yang berupa sebagai ditandatangani oleh seorang juruanalisis hendaklah, apabila perakuan itu dikemukakan oleh Pendakwa Raya, menjadi keterangan yang mencukupi mengenai fakta yang dinyatakan dalam perakuan itu melainkan jika tertuduh menghendaki supaya juruanalisis itu dipanggil sebagai saksi, yang dalam hal demikian dia hendaklah memberikan notis mengenai perkara itu kepada Pendakwa Raya tidak kurang daripada tiga hari genap sebelum perbicaraan bermula. (2) Jika Pendakwa Raya berhasrat untuk memberikan sebagai keterangan apa-apa perakuan analisis, dia hendaklah menyerahkan suatu salinan perakuan itu kepada tertuduh tidak kurang daripada sepuluh hari genap sebelum perbicaraan bermula. (3) Juruanalisis adalah terikat untuk menyatakan yang benar dalam perakuan analisis yang ditandatangani sendiri oleh mereka. (4) Bagi maksud seksyen ini, “juruanalisis” ertinya— (a) seorang ahli kimia berdaftar di bawah Akta Ahli Kimia 1975 [Akta 158] atau seorang yang diberi kuasa di bawah seksyen 23 a Akta itu, atau pekerjanya yang bekerja di bawah penyeliaannya; (b) seorang ahli farmasi berdaftar di bawah Akta Pendaftaran Ahli Farmasi 1951 [Akta 371] atau pekerjanya yang bekerja di bawah penyeliaannya; (c) seorang jurutera berdaftar di bawah Akta Pendaftaran Jurutera 1967 [Akta 138]; atau (d) seorang ahli geologi berdaftar di bawah Akta Geologi 2008 [Akta 689]. (5) Jika seorang juruanalisis dipanggil sebagai saksi oleh tertuduh di bawah subseksyen (1), juruanalisis itu hendaklah dipanggil atas perbelanjaan tertuduh itu melainkan jika mahkamah mengarahkan selainnya. (6) Menteri boleh melantik mana-mana orang yang layak atau golongan orang yang layak, melalui pemberitahuan dalam Warta, sebagai juruanalisis bagi maksud seksyen ini.
