s 152 Power of Registrar to allow amendments of documents

(1) The Registrar may, upon an application in the form as determined by the Registrar together with the payment of the prescribed fee and on such terms as to costs as he thinks just, whether for the purpose of amending a clerical error or an obvious mistake, allow the amendment of— (a) an application for the registration of trademark; (b) notice of opposition; (c) counterstatement; or (d) any documents as the Registrar thinks fit. (2) An amendment applied under subsection (1), shall not be permitted, under this section if the amendment would substantially affect— (a) the identity of the trademark as specified in the application before amendment or without extending in any way the rights given by the existing registration of trademark; or (b) the content of the documents filed with the Trademarks Office.

Kuasa Pendaftar untuk membenarkan pindaan dokumen

(1) Pendaftar boleh, apabila suatu permohonan mengikut bentuk yang ditentukan oleh Pendaftar bersama-sama dengan pembayaran fi yang ditetapkan dan atas apa-apa terma mengenai kos sebagaimana yang difikirkannya adil, sama ada bagi maksud meminda suatu kesalahan perkeranian atau kesilapan yang jelas, membenarkan pindaan— (a) suatu permohonan bagi pendaftaran cap dagangan; (b) notis bangkangan; (c) kenyataan balas; atau (d) apa-apa dokumen yang difikirkan patut oleh Pendaftar. (2) Pindaan yang terpakai di bawah subseksyen (1), tidak dibenarkan, di bawah seksyen ini jika pindaan itu akan memberi kesan yang substantial kepada— (a) identiti cap dagangan sebagaimana yang dinyatakan dalam permohonan sebelum pindaan atau tanpa memperluas dengan apa-apa cara hak yang diberikan oleh pendaftaran cap dagangan yang sedia ada; atau (b) kandungan dokumen yang difailkan dengan Pejabat Cap Dagangan.
