The Conservation of Habitats and Species (Amendment) Regulations 2012

These Regulations amend the Conservation of Habitats and Species Regulations 2010 (S.I. 2010/490 ) (“the 2010 Regulations”), which make provision transposing Council Directive 92/43/EEC on the conservation of natural habitats and of wild fauna and flora (“the Habitats Directive”) and certain aspects of Directive 2009/147/EC on the conservation of wild birds (“the Birds Directive”) .
(1) These Regulations may be cited as the Conservation of Habitats and Species (Amendment) Regulations 2012 and come into force on 16th August 2012.
(2) In these Regulations, “ the 2010 Regulations ” means the Conservation of Habitats and Species Regulations 2010 .
(3) Except as provided in paragraphs (4) and (5), these Regulations extend to England and Wales only.
(4) This regulation and regulations 2 to 7, regulation 8 in so far as it relates to regulations 9 and 9A of the 2010 Regulations, and regulations 19 to 21 also extend to Scotland and Northern Ireland.
(5) Regulations 3(4) and 24 extend to Scotland only.
Any notice given before 16th August 2012 under, or having effect as if given under , regulation 20(1)(a) of the 2010 Regulations as in force immediately before that date, has effect as if given under section 28E(1)(a) of the Wildlife and Countryside Act 1981 .
In section 15 of the National Parks and Access to the Countryside Act 1949 (meaning of “nature reserve”), after subsection (2) insert—
(2A) In subsection (2)(b) the reference to preserving flora or fauna includes enabling or facilitating its recovery or increase.
