Breaches

(1) A seller breaches these Regulations if, as a result of having failed to take all reasonable steps necessary to enable it to do so, a seller fails to comply with a requirement mentioned in paragraph (2). (2) The requirements are— (a) the requirement to charge in accordance with regulation 6; (b) the requirement to keep records in accordance with regulation 8; (c) the requirement to retain records in accordance with regulation 8; (d) the requirement to supply records in accordance with regulation 9; (e) the requirement to publish records in accordance with regulation 10. (3) A seller breaches these Regulations if, without reasonable cause, a seller— (a) gives false or misleading information to an administrator; (b) otherwise obstructs or fails to assist an administrator in the conduct of its functions under these Regulations.
