s 118 Restrictions on disclosure of information.
(1) If any person discloses to any other person— (a) any information with respect to any manufacturing process or trade secret obtained by him in premises which he has entered by virtue of section 111 of this Act, or (b) any information obtained by or furnished to him in pursuance of this Act, he shall, unless the disclosure was made in the performance of his duty, be guilty of an offence. (1A) Subsection (1) of this section does not apply if– (a) the person making the disclosure is, or is acting on behalf of a person who is, a public authority for the purposes of the Freedom of Information Act 2000 or a Scottish public authority for the purposes of the Freedom of Information (Scotland) Act 2002 , and (b) the information is not held by the authority on behalf of another person. (2) Any person guilty of an offence under this section shall be liable— (a) on summary conviction, to a fine not exceeding £400; (b) on conviction on indictment, to a fine or to imprisonment for a term not exceeding two years or to both.
