Where— (a) any notice required by section 35E(1) or 39(2) of this Act or paragraph 5A(3E) or 5C(5) above to be served on a person by the Registrar or the MPTS is served on him by sending it by post; and (b) the Registrar is or (as the case may be) the MPTS are satisfied, on an application of that person, that the person did not receive the notice within 14 days beginning with the day of the giving of the decision to which the notification relates, the Registrar or (as the case may be) the MPTS may, if he or they think fit, by authorisation in writing extend the time within which an appeal under section 40 of this Act or paragraph 5A(5) or 5C(7) above ... may be brought against the decision.
