Police and Criminal Evidence Act 1984

Police and Criminal Evidence Act 1984 s 47ZJ

s 47ZJ Sections 47ZF and 47ZG: late applications to magistrates’ court

(1) This section applies where— (a) an application under section 47ZF or 47ZG is made to a magistrates’ court before the end of the applicable bail period in relation to a person, but (b) it is not practicable for the court to determine the application before the end of that period. (2) The court must determine the application as soon as is practicable. (3) The applicable bail period in relation to the person is to be treated as extended until the application is determined. (4) If it appears to the court that it would have been reasonable for the application to have been made in time for it to have been determined by the court before the end of the applicable bail period in relation to the person, it may refuse the application.
