Sch 12 para 5

Subject to paragraph 6 below, the Secretary of State may at any time remove a person from office as an assessor if satisfied that— (a) he has been convicted of a criminal offence; (b) he has become bankrupt or has had his estate sequestrated or has made an arrangement with, or granted a trust deed for, his creditors; (ba) a debt relief order (under Part 7A of the Insolvency Act 1986) has been made in respect of him; (bb) he has become the subject of a bankruptcy restrictions order under Schedule 2A to the Insolvency (Northern Ireland) Order 1989 (bc) debt relief order (under Part 7A of the Insolvency (Northern Ireland) Order 1989) has been made in respect of him; (bd) he has become the subject of a debt relief restrictions order (under Part 7A of the Insolvency (Northern Ireland) Order 1989); (c) he is incapacitated by physical or mental illness; or (d) he is otherwise unable or unfit to perform his duties.
