1 This paragraph applies in relation to planning permission deemed to have been granted to the authority under regulation 4 of the Town and Country Planning General Regulations 1976 (deemed planning permission for development by local authorities) which subsists at the vesting date. (2) Any planning permission to which this paragraph applies which authorises the use of land by the authority for the treatment, keeping or disposal of waste shall, on the transfer of the land to the company by the scheme, enure for the benefit of the land.
