(1) Section 124 of the Benefits Act (entitlement to income support) is amended as follows. (2) For subsection (1)(a) substitute- (a) he is of or over the age of 16; (3) Omit “and" at the end of subsection (1)(c). (4) For subsection (1)(d) substitute— (d) except in such circumstances as may be prescribed, he is not receiving relevant education; (5) In subsection (1), after paragraph (d) insert— (e) he falls within a prescribed category of person; and (f) he is not entitled to a jobseeker’s allowance and, if he is a member of a married or unmarried couple, the other member of the couple is not entitled to an income-based jobseeker’s allowance.
