(1) The Water (Scotland) Act 1980 shall be amended in accordance with the following provisions of this paragraph. (2) In section 93 (obtaining of information as to underground water) after subsection (7) there shall be inserted— (8) Any person who in keeping a journal under subsection (1) or in furnishing information under subsection (2) or (3) makes any statement which he knows to be false or misleading in a material particular or recklessly makes any statement which is false or misleading in a material particular shall be guilty of an offence and shall be liable— (a) on summary conviction, to a fine not exceeding the statutory maximum; (b) on conviction on indictment, to a fine or to imprisonment for a term not exceeding two years, or to both. (3) In section 94 (false information) after the word “Act” there shall be inserted the words “ (other than by or under section 93) ” .
