(1) In section 41(2) for “Secretary of State” substitute “ Department of the Environment ” . (2) In section 41 for subsections (3) and (4) substitute— (3) Any person who uses a regulated public service vehicle in contravention of this section is guilty of an offence and liable on summary conviction to a fine not exceeding level 4 on the standard scale.
