(1) Paragraphs 11 and 12 apply where, at a time when an offender under the age of 18 is subject to referral, a youth court or other magistrates’ court (“the relevant court”) is dealing with him for an offence in relation to which paragraphs (a) to (c) of section 1(1) are applicable. (2) But paragraphs 11 and 12 do not apply unless the offender’s compliance period is less than 12 months.
