(1) The governing body of— (a) an institution within the further education sector, (aa) a registered higher education provider of a description prescribed by regulations made by the Secretary of State for the purposes of section 39(1) of the Higher Education and Research Act 2017, (b) a university receiving financial support under section 65 of the Further and Higher Education Act 1992, (c) an institution in Wales conducted by a higher education corporation, (d) a designated institution for the purposes of Part II of the Further and Higher Education Act 1992 as defined by section 72(3) of that Act, or (e) any college, school, hall or other institution of a registered higher education provider which falls within paragraph (aa) or a university which falls within paragraph (b). (2) In sub-paragraph (1)— (a) “ governing body ” is to be interpreted in accordance with subsection (1) of section 90 of the Further and Higher Education Act 1992 but without regard to subsection (2) of that section, (aa) “registered higher education provider” has the meaning given by section 3(10) of the Higher Education and Research Act 2017, (b) in paragraph (a), the reference to an institution within the further education sector is to be construed in accordance with section 91(3) of the Further and Higher Education Act 1992, (c) in paragraph (c)— (i) the reference to an institution in Wales is to an institution whose activities are carried on, or principally carried on, in Wales, but includes the Open University, and (ii) “ higher education corporation ” has the meaning given by section 90(1) of the Further and Higher Education Act 1992, and (d) in paragraph (e) “ college ” includes any institution in the nature of a college.
