(1) The chairman and non-executive members are to be appointed by the Secretary of State. (2) Of the non-executive members at least one (but not more than four) must be persons who are also appointed to be health and social care commissioners under paragraph 10. (3) Regulations may— (a) prescribe conditions which must be satisfied in relation to a person before he is appointed as chairman or as a non-executive member; (b) make provision as to the circumstances in which a person is disqualified for being the chairman or a non-executive member.
