(1) Each NHS trust has a board of directors consisting of— (a) a chairman appointed by NHS England , and (b) executive and non-executive directors. (2) Sub-paragraph (1)(b) is subject to paragraph 7(2). (3) An executive director is a director who is an employee of the NHS trust, and a non-executive director is a director who is not an employee of the NHS trust. (4) Sub-paragraph (3) is subject to any provision made by regulations under paragraph 4(1)(d).
