s 6 Performance of functions outside England

(1) Where the Secretary of State has a duty or power to provide anything under section 2A or 2B or Schedule 1, that thing may be provided outside England. (1A) Where an integrated care board or NHS England has a duty or power to arrange for the provision of anything under section 3, 3A, 3B or 4 or Schedule 1, it may arrange for that thing to be provided outside England. (2) The functions of the Secretary of State, NHS England and integrated care boards may be performed outside England and Wales, in so far as they relate to— (a) holidays for patients, (b) the transfer of patients to or from Scotland, Northern Ireland, the Isle of Man or the Channel Islands, or (c) the return of patients who have received treatment in England and Wales, to countries or territories outside the British Islands (including for this purpose the Republic of Ireland).
