Sch 6A para 14
A person who— (a) is sentenced by the Court Martial under paragraph 25(2)(b)(ii) of Schedule 10 to the Sentencing Code as applied by this Schedule, and (b) was not convicted by the Court Martial of the offence in respect of which the sentence is passed, is to be treated, for the purpose of enabling an appeal under the Court Martial Appeals Act 1968 against the sentence, as if he or she had been so convicted.
