In section 1 of the Emergency Workers (Obstruction) Act 2006 (obstructing emergency workers)— (a) in subsection (5), in paragraph (a)— (i) after “Wales,” insert “the Secretary of State in the exercise of public health functions, a local authority in the exercise of public health functions, the National Health Service Commissioning Board, a clinical commissioning group,”, and (ii) omit “, Primary Care Trust”, and (b) after that subsection insert— (6) In subsection (5)(a) above “public health functions”— (a) in relation to the Secretary of State, has the same meaning as in section 1H(5)(a) of the National Health Service Act 2006; (b) in relation to a local authority, has the same meaning as in section 1H(5)(b) of that Act.
