(1) Section 5 (rights of access etc. for Agency inspectors) is amended as follows. (2) After subsection (3) insert— (3A) The Secretary of State must consult the Office for Nuclear Regulation before making an order under subsection (3) unless the order gives effect, without modification, to any proposals for such an order submitted by the Office for Nuclear Regulation under section 81(1)(a)(v) of the Energy Act 2013. (3) In subsection (6) for “Secretary of State” substitute “ Office for Nuclear Regulation ” .
