(1) Section 58 (findings of fact by CMA) is amended in accordance with this paragraph. (2) In subsection (1), after “the court” insert “ or the Tribunal ” . (3) In subsection (2)— (a) in the definition of “Part I proceedings”, before paragraph (a) insert— (za) in respect of an infringement decision; (b) in the definition of “relevant party”, in paragraphs (a) and (b), for “is alleged to have infringed the prohibition” substitute “ has been found to have infringed the prohibition or is alleged to have infringed the prohibition (as the case may be) ” . (4) In subsection (3)— (a) after “Rules of court” insert “ or Tribunal rules ” , and (b) after “the court” insert “ or the Tribunal ” . (5) After subsection (3) insert— (4) In this section “ the court ” means— (a) in England and Wales or Northern Ireland, the High Court, (b) in Scotland, the Court of Session or the sheriff.
