Nothing in regulations 7(3) or 8(2) shall apply to — (a) the procurator fiscal or the Lord Advocate, or (b) a constable acting in accordance with directions given by the appropriate chief constable under section 17(2) of the Police (Scotland) Act 1967 in pursuance of lawful instructions received by him from the appropriate prosecutor under section 17(3) of that Act.
