reg 8 Determination: Schedule A2 projects
(1) Subject to regulations 9 to 10 , the appropriate authority must determine that an environmental impact assessment is required in relation to a regulated activity that is to be carried out in the course of a Schedule A2 project, if it concludes that the project in question is likely, because of its size, nature or location, to have significant effects on the environment. (2) In reaching a conclusion as to whether or not a Schedule A2 project is likely to have significant effects on the environment, the appropriate authority must have regard to the criteria set out in Schedule 1.
