reg 3 Designation of States or parts of States for the purposes of section 94 of the 2002 Act
After subsection (5C) of section 94 of the 2002 Act insert – (5D) In deciding whether the statements in subsection (5) (a) and (b) are true of a State or part of a State, the Secretary of State – (a) shall have regard to all the circumstances of the State or part (including its laws and how they are applied), and (b) shall have regard to information from any appropriate source (including other member States and international organisations).
